If water could enter into the secondary containment by precipitation or <br /> infiltration, it must be removed and disposed of properly. The service technician removed 5 cups of liquid from UDC <br /> 5/6 sump. Ensure that all sumps and annular spaces are maintained free of liquid. <br /> This was corrected while inspector was on site. <br /> This is a repeat violation, Class II. <br /> 319 CCR 2635, 2637.1, 2665, 2712 No spill bucket, failed to contain 5 gallons, no means to keep it empty, or failed to be <br /> tested. <br /> The Diesel direct-bury spill container failed when tested. All spill containers shall have a minimum capacity of five <br /> gallons and be capable of containing a spill or overfill until it is detected or cleaned up. Immediately discontinue <br /> deposition of petroleum into this tank until the component is repaired or replaced by a properly licensed, trained, and <br /> certified contractor under permit and inspection of the EHD. The Diesel spill container had red tag#4210 affixed <br /> prior to the inspection, because this spill container is direct buried, the red tag will remain on the Diesel tank until <br /> repairs are completed. <br /> This is a repeat violation, Class II. <br /> 320 CCR 2635, 2637.2, 2665, 2712 Failure to comply with the installation, inspection, or record keeping of the overfill <br /> prevention. <br /> The Mechanical overfill prevention system used as the overfill prevention system is not currently functional on the <br /> 100 octane, 110 octane, 87 (1) product, 87 (2) product, and 91 product UST system because it is set above 95%. <br /> Immediately repaired or replaced by a properly licensed, trained, and certified contractor under permit and <br /> inspection of the EHD. If the failed component can't be replaced immediately, there is a possibility that the 100 <br /> octane, 110 octane, 87 (1) product, 87 (2) product, and 91 product UST system may be red tagged to prevent fuel <br /> inputs. The operator, Pete Chahoud, is aware of the failures and provided a statement to the inspector stating that <br /> he would repair and retest with passing results by 1/18/19 or he would be red tagged. <br /> This is a Class II violation. <br /> 329 HSC 25298 Failed to comply with all permanent closure requirements. <br /> This UST system was found to be illegally abandoned. No person shall abandon an UST system without complying <br /> with the requirements of HSC 25298. Immediately obtain a permit from the EHD to remove this UST system. A <br /> "Failure to Obtain a Permit" penalty applies. <br /> The operator provided a statement to close this violations while the inspector was on site. <br /> This was corrected on site. <br /> This is a repeat violation, Class II. <br /> Overall Inspection Comments: <br /> An inspection report was provided to the facility operator on the day of inspection.
