JJW Geosciences,'Inc (JJW) submitted the <br /> work plan addendum on your behalf in July 2000. The approved site work was not <br /> completed until May 2001 and only then after repeated directives by PHS/EHD to get it <br /> done. It has been five months since the work was completed,'6d a report of findings <br /> has not been submitted to PHS/EHD for review. A routine quarterly monitoring and <br /> sampling event was performed in June 2001, but a report of this work also has not been <br /> submitted for review. Another quarterly monitoring event should have taken place in <br /> September 2001. <br /> i <br /> As the Responsible Party to this site Mr. Cervantes, you are required by California Code <br /> of Regulations Title 23Division 3 Chapter 16, <br /> Article 1 � to invi <br /> esti ate the full extent of <br /> and remediate the unauthorized release of petroleum hydrocarbon contamination that <br /> " <br /> occurred as a result of your operation of underground storage!tanks previously located <br /> on the property. While this process can be costly and time consuming, PHSIEHD <br /> considers the delays repeatedly experienced at this particular site to be excessive. <br /> PHSIEHD therefore directs the following: <br /> 1. Submit the report of findings for the investigation completed in May 2001 to <br /> PHS/EHD by October 29, 2001. If the report is not received by PHS/EHD by this <br /> date the site will be considered out of compliance with reg I latory directives and <br /> report of that fact will be made to the State Water Resources Control Board Cleanup <br /> Fund, and formal enforcement action will be requested from the Regional Water <br /> Quality Control Board, Central Valley Region. <br /> 2. Submit the Quarterly Groundwater Monitoring Report for the June 2001 event to <br /> PHSIEHD immediately. You have already received a directive that quarterly <br />` groundwater monitoring and sampling must continue;at this site until directed <br /> otherwise by PHSIEHD. In the future, all Quarterly Groundwater Monitoring Reports <br />!, must be submitted within 60 days following the event.
