R5-2003-0061 <br /> (NPDES NO. CA0082848) AND <br /> CEASE AND DESIST ORDER NO. R5-2003-0062 <br /> FOR Ill <br /> SAN JOAQUIN COUNTY SERVICE AREA 31 <br /> FLAG CITY WASTEWATER TREATMENT PLANT <br /> SAN JOAQUIN COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Region (hereafter Regional Water Z <br /> Board) finds: <br /> 1. The San Joaquin County Service Area 31 (hereafter Discharger) discharged tertiary treated <br /> municipal wastewater from the Flag City area to Highline Canal, a water of the United States, within <br /> the legal boundaries of the Sacramento-San Joaquin Delta, at the point latitude 36° 6' 25" N and <br /> longitude 1210 24' 36"W. Waste Discharge Requirements Order No. R5-2003-0061 (NPDES No. <br /> CA0082848), adopted by the Regional Water Board on 25 April 2003, prescribed requirements for <br /> the discharge. Order No. R5-2003-0061 included effluent limitations for several constituents, with <br /> which the Discharger could not immediately comply. <br /> 2. Cease and Desist Order No. R5-2003-0062, adopted by the Regional Water Board on <br /> 25 April 2003, provided a time schedule for the Discharger to comply with the effluent limitations <br /> that the Discharger could not immediately comply. <br /> 3. The Discharger recently completed the construction of a pump station and dual forcemain project <br /> that allows for discharge of the Flag City wastewater to the City of Lodi White Slough Water <br /> Pollution Control Facility (WPCF). As of 10 April 2008, all wastewater flows from the Flag City area <br /> are being directed to the Lodi WPCF, and the discharge to Highline Canal has ceased. Therefore, <br /> the Orders are no longer necessary, and the Discharger requested the rescission of the Orders by <br /> letter dated 29 April 2008. <br /> 4. The Discharger and interested parties were notified of the intent to consider rescission of Order <br /> Nos. R5-2003-0061 and R5-2003-0062 and provided an opportunity for public hearing and an <br /> opportunity to submit written views and recommendations. <br /> 5. The Issuance of this Order is exempt from the provisions of the California Environmental Quality Act <br /> (Public Resources Code, Section 21000 et seq.), in accordance with Title 14, California Code of <br /> Regulations, Section 15321. C <br /> IT IS HEREBY ORDERED that Waste Discharge Requirements Order No. R5-2003-0061 and Cease <br /> and Desist Order No. R5-2002-0062 are rescinded. <br /> I, PAMELA C.
