(McDonald Island Landfill) <br /> Count/Charges: <br /> Ct. 1: Health and Safety Code Section 15189.5(b) <br /> Ct. 2: Health and Safety Code Section 25189.5(b) <br /> Ct. 3: Health and Safety Code Section 25189.5(b) <br /> ( � ) As to Count 1, Defendant enters a plea of no contest to <br /> H & S Code Section 25189.5(b) , Hazardous Waste Disposal, <br /> fine of $10, 000, payable on May 12, 1993. <br /> ( � ) As to Count 21 Defendant enters a plea of no contest to <br /> H & S Code Section 25189.5(b) , Hazardous Waste Disposal, <br /> fine of $5,0000 payable on May 12, 1993 . <br /> 3 <br /> ( ) As to Coun # Defendant enters a plea of no contest to <br /> H 8 S Code action 25189.5(b) , Hazardous Waste Disposal, <br /> fine of $5, 000, payable on May 12, 1993 . <br /> ( ) ***** If any five gallon or larger container, which was <br /> not staked, marked and photographed by San Joaquin County <br /> Environmental Health prior to the entry of plea contains <br /> 104 or more, by volume, hazardous waste is discovered <br /> during the cleanup, an additional fins of TWENTY FIVE <br /> THOUSAND DOLLARS ($25,000.00) shall be paid no later than <br /> July 1, 1992 <br /> ( � ) The landfill site shall be immediately cleaned up in <br /> accordance with an approved "Clean Closure Plan". This <br /> plan has been drafted and forwarded to San Joaquin County <br /> Environmental Health and work will begin upon approval. <br /> ( ) Due to the level of cooperation of the Board of Directors <br /> with regard to corporate responsibility and the over TWO <br /> HUNDRED THOUSAND DOLLARS ($200,000.00) that Zuckerman- <br /> Mandeville, Inc. shall budget for environmental cleanup <br /> and compliance during the next two years there will be no <br /> additional charges filed against any corporate officers, <br /> employees of Zuckerman-Mandeville, Inc. , nor anyone also <br /> connected with the previously occurring unlawful disposal <br /> of hazardous and nonhazardous wastes at the McDonald <br /> Island site that this agreement covers. <br /> *Proof of such budgeting shall be shown to the District <br /> Attorney. Every six months the Board of Directors for <br /> Zuckerman-Mandeville, Inc. (hall provide evidence of the <br /> expenditures from this budgeting. <br />
