That sampling
is planned for completion by the end of next week.
The results of the sampling on our property will be gathered together by the County
Environmental Health Department together with the results of the sampling which you have
performed on your property and forwarded to the State Regional Water Quality Control Board
for its review and recommendations as to whether both of us can be assured that the clean-up
efforts have been sufficient to avert future environmental harm. Your sampling results should
be sent directly to Donna Heran at the Environmental Health Department and she will perform
the coordinating services for the samples.
In addition to the soil samples which will be sent to the State, Donna will at the same
time coordinate the review of your water well sample and request that the Regional Water
Quality Control Board make recommendations concerning the periodic monitoring of your well
concerning the Schappman urea spill. If you would also send the results of the water well
sampling together with sampling results for that well from the past three years to provide a valid
baseline comparison, the material will be followed up by Donna Heran.
We must also promptly deal with the contaminated soils which were removed from our
property and currently are stored on your property. We thank you.for your offer to store the
soils on your property and for selecting a place on which the soils could be temporarily stored.
In order to manage the potential for liability which could arise if the County does not effect final
disposal of those soils, the County will remove the soils immediately upon your approval, or in
any event, no later than the end of next week. You have indicated that you might be interested
in keeping the soils since they are valuable not only as additional soil but for the quality urea
contained in the soils which you would use to fertilize your fields. Our legal counsel advises
me that if you wish to retain the soils the County could release them to you only if we had
