written documentation that you accepted them in the condition they now exist knowing that they
contain urea from the Schappman spill and that you assume full ownership and responsibility for
proper use and or disposal of the soils. A statement to this effect has been enclosed for your
use or you may have your legal counsel suggest additional language to our attorney, Rebecca
Davis (468-2980) for consideration.
I have requested information from the Agricultural Commissioner as to thr, licenses under
which Mr. Schappman operates in handling farm chemicals. The Agricultural Commissioner
advised me that Mr. Schappman currently holds a private grower-certificate which allows pest
control applications on owned or operated lands. Fertilizers are exempt from these regulations.
Finally, I requested an update from the District Attorney's Office regarding possible
action that Office would be taking concerning the Schappman spill. That office will contact you
or you may wish to express your concerns directly to that office.
Very truly yours,
Y G
/ROBER . CABRAL
Supervisor, Fifth District
