Sinclair <br /> Stockton, CA 95205 <br /> Dear Mr. Daly, <br /> REPORT OF VIOLATION AND SCHEDULE FOR COMPLIANCE <br /> On May 8, 1987, the Department of Health Services- (DHS) conducted <br /> an inspection of Marley Cooling Tower Co. , Stockton, CA. <br /> As a result of that inspection, violations of the hazardous waste <br /> statutes and regulations were identified. <br /> Specific violations and required corrective action are listed <br /> below. Failure to correct the identified violations within the <br /> schedule provided will result in DHS citing you for continuing/ <br /> additional violations. <br /> I . Schedule of Violations <br /> 1. Section 66371, Title 22, California Administrative Code <br /> (a) Permits are required for treatment, storage or disposal of <br /> hazardous waste. Owners and operators of hazardous waste facilities shall <br /> have permits during the active Life (including the closure period) of the <br /> facility and, for any facility which closes after January 26, 1983, during <br /> any post-closure care period required under Section 67217, and during an <br /> compliance period specified under Section 67186, including any extension of <br /> that compliance period under Section 67186 (c). <br /> (c) The following persons are among those who are not required to <br /> obtain a permit: <br /> (1) Generators who accumulate hazardous waste on site for less than 90 <br /> days, as provided in Section 66508. <br /> (2) Persons adding absorbent material to waste in a container (as <br /> defined in Section 66028 of this chapter) and persons adding waste to <br /> absorbent material in a container, provided that these actions occur at the <br /> time waste is first placed in the container and Sections 67106 (b), 67241 <br /> and 67242 of this chapter are complied with. <br /> (3) A person is not required to obtain a permit for those activities he <br /> carries out to immediately contain or treat a spill of hazardous waste or <br /> material. <br />
