i • <br /> Marley Cooling Tower Co. 2 <br /> (e) Where waste discharge requirements are established pursuant to <br /> Sections 13260 and 13263 of the Water Code, they shall be incorporated <br /> verbatim into the Hazardous Waste Facility Permit issued to the applicant <br /> pursuant to this article. <br /> Marley Cooling Tower stores hazardous waste in containers <br /> and on pallets longer than 90 days without a permit. <br /> 2. Section 66508 (a) 3, Title 22, California Administrative <br /> Code <br /> (a) A generator may accumulate hazardous waste on site for 90 days or <br /> Less without a permit or without having interim status provided that: <br /> (3) While being accuru lated on site, each container and tank is labeled <br /> or marked clearly with the words, "Hazardous Waste", and the additional <br /> Language as required under subsection (c) of this section. <br /> Drums storing hazardous waste did not have the required <br /> hazardous waste label or accumulation date. <br /> 3. Section 67243 (a) (b) , Title 22, California <br /> Administrative Code <br /> (a) A container holding hazardous waste shall always be closed during <br /> storage, except when it is necessary to add or remove waste. <br /> (b) A container holding hazardous waste shall not be opened, handled or <br /> stored in a manner which may rupture the container or cause it to leak. <br /> Drums containing hazardous waste were open during storage. <br /> 4. Section 67102 (a) 1, Title 22, California Administrative <br /> Code <br /> (a) (1) Before an owner or operator treats, stores or disposes of any <br /> hazardous waste, he shall obtain a detailed chemical and physical analysis <br /> of a representative sample of the waste. At a minimum, this analysis shall <br /> contain all the information which must be known to treat, store of dispose <br /> of the waste in accordance with the requirements of Articles 18 through 32 <br /> or with the conditions of a permit issued under Article 4 of this chapter. <br /> (2) The analysis may include data developed under Article 11 of <br /> this chapter and existing published or documented data on the hazardous <br /> waste or on hazardous waste generated from similar processes. <br /> (3) The analysis shall be repeated as necessary to ensure that it <br /> is accurate and up to date. At a minimum, the analysis shall be repeated: <br /> (A) When the owner or operator is notified, or has reason to believe, <br /> that the process or operation generating the hazardous waste has changed. <br /> (B) For off-site facilities, when the results of the inspection <br /> required in subdivision (a) (4) of this section indicate that the hazardous <br /> waste received at the facility does not match the waste designated on the <br /> accompanying manifest or shipping paper. <br />
