The meeting was <br /> both productive and informative. Since numerous subjects were <br /> discussed and a variety of additional informational requests were <br /> made, this letter will serve to summarize the results of the <br /> meeting and to delineate the additional information required from <br /> the MCTC. <br /> The MCTC closure of the subject surface impoundment is governed, <br /> presently, by two Department of Health Services (DHS or <br /> Department) and the Environmental Protection Agency (EPA) <br /> approved documents, the Closure Plan (CP) , as amended by DHS-EPA <br /> and the Remedial Action Order (RAO) , both of which are legally <br /> enforceable documents. The MCTC is obligated to comply with both <br /> of these documents until they are formally amended by DHS-EPA. <br /> The MCTC is presently in violation of both the CP and the RAO and <br /> has failed to complete the directed remedial action and interim <br /> closure measures which require removal of the hazardous waste <br /> from the surface impoundment and disposal in an authorized, <br /> off-site disposal area. Thus, the MCTC is still obligated to <br /> remove the hazardous waste from the surface impoundment in <br /> accordance with the approved CP and RAO. <br /> In response to the MCTC request, the DenartTnent ba-- agreed to <br /> consider and evaluate two MCTC proposals: <br /> 1. Winterization of the surface impoundment. <br /> 2 . Closure of the surface impoundment with the hazardous <br /> waste left in place and the installation of a flushing <br /> system under the hazardous waste. <br />
