If Lessee exercises the extension contained in this Paragraph 13(o, lessee agrees to <br /> pay Lessor rental for the use and occupancyof the Leascd Premises,in advance on the first day of <br /> each and every,calendar month during said one (1)year period, or any,extension thereof,the exact <br /> sum of Three Thousand Nine Hundred Dollars.($3,900.00). <br /> 14. (a) "Motor;Fuel Hydrocarbon Contamination" means-tnowr fuels (such as <br /> gasoiines and diesel fueI),lubricating oils,and waste oil which are caused to.become present on the <br /> Leased Premises as a result of.Lessee's operation on the Leased premises.and which violate <br /> applicable federal,state or local laws as in effect and as-enforced during the term of this Lease, or <br /> any extension thereof'. "Covered Contamination"means Motor Fuel Hydrocarbon Contamination <br /> or other environmental contamination caused to become present on the Leased,Premises as a result <br /> of Lessee's operation on the Leased Premises and which violates applicable federal, state or local <br /> laws as in effect and as etttvrccd during the term of this Leas,c,.or arty extension thereof. <br /> (b) Covered Contamination Claim("Claire") means receipt,by Lessor or Lessee <br /> of a notice,claim, demand,or complaint from any third party,or from any government agency with <br /> jurisdiction for the payment of damages, costs, or expenses for the presence of or the escape, <br /> leakage,spillage, discharge,emission or release from the Leased Premises into or"onto the Leased <br /> Premises, adjacent land, or any watercourse, body of-water, or wetland, of any Covered <br /> Contamination. <br /> (c) If a Claire occurs, the party first receiving notice. of the Claim will <br /> immedizte)y notify the odder party, and Lessee will proceed after receipt of notice of the Claim to <br /> assess and, if required; to remediate the Covered Contamination 'in full compliance with all <br /> applicable laws and regulations. If any correctiveworkis undertaken hereunder„Lesse shall be <br /> deemed to have satisfied its obligations to correct any Covered Contamination if Lessce-corrects <br /> such Covered Contamination to the satisfaztion of the governmental agency having jurisdiction.
