WASTE DISCHARGE REQUIREMENTS -5- <br /> MARLEY COOLING TOWER COMPANY <br /> SAN JOAQUIN COUNTY <br /> 21. The action to adopt a modification to an existing NPDES permit is exempt <br /> from the provisions of the California Environmental Quality Act (Public <br /> Resources Code Section 21000, et seq. ) , in accordance with Section 13389 of <br /> the California Water Code. <br /> 22. The Board has notified the Discharger and interested agencies and persons <br /> of its intent to modify the existing NPDES permit for this Discharger and <br /> has provided them with an opportunity for a public hearing and an <br /> opportunity to submit their written views and recommendations. <br /> 23. The Board, in a public meeting, heard and considered all comments <br /> pertaining to the discharge. <br /> 24. This Order shall take effect ten days from the date of hearing, provided <br /> EPA has no objections. <br /> IT IS HEREBY ORDERED that The Marley Cooling Tower Company, Stockton, in order <br /> to meet the provisions contained in Division 7 of the California Water Code and <br /> regulations adopted thereunder, shall comply with the following: <br /> 1. All of the prohibitions, effluent limitations, sludge disposal conditions, <br /> receiving water limitations, and provisions contained in Board Order No. <br /> 88-124 except for the following modifications of Effluent Limit 4 and <br /> Provision 6, respectively: <br /> a. The 30-day average daily discharge shall not exceed 0.59 million <br /> gallons. <br /> b. The Discharger shall implement an invertebrate follow-up effluent <br /> toxicity monitoring program on the combined effluent from the existing <br /> and interim treatment plants, in accordance with procedures outlined in <br /> the Environmental Protection Agency' s (EPA) Documents 600/4-89/001 and <br /> 440/4-85-032 to demonstrate that the combined effluent does not have a <br /> reasonable potential to cause instream toxicity. The Discharger shall <br /> propose a plan with a time schedule to meet this objective. The <br /> Discharger shall carry out the toxicity monitoring program in <br /> accordance with the following schedule: <br /> 1) By 1 February 1991, a proposed plan shall be submitted to the Board <br /> for approval . The Plan shall be implemented after approval . <br /> 2) By 1 July 1991, a Technical Report summarizing and interpreting the <br /> results of the toxicity testing program shall be submitted. This <br /> information will be reviewed and effluent limitations may be <br /> revised accordingly. At that time, the Board may revise this Order <br /> to reflect the new limitations. <br />
