5. The establishment, maintenance or operation of the proposed use is not expected <br /> to endanger, jeopardize or otherwise constitute a hazard to the public convenience, <br /> health, interest, safety or general welfare of persons residing or working in the <br /> neighborhood of the subject use, because the subject use will be required to comply <br /> with all applicable building and fire codes. <br /> 6. The design, location, size and operating characteristics of the subject use are <br /> expect to be compatible with existing and future land uses in the vicinity of the <br /> subject property, because the subject use is an industrial use 'that will be located <br /> within an existing industrially-developed area. <br /> 7. The proposed action is in compliance with the provisions of the California <br /> Environmental Quality Act (CEQA) and the City's CEQA Guidelines. The project is <br /> categorically exempt pursuant to Section 15301, Class 1, of the CEQA Guidelines, <br /> because it meets the specified conditions for the use of an existing facility. <br /> Conditions of Approval <br /> In accordance with SMC Section 16.168.070, the following Conditions of Approval are <br /> imposed to ensure compliance with the Findings of Fact recited above: <br /> 1. This Use Permit shall become valid eleven days after approval, unless the action is <br /> appealed. <br /> 2. The operator shall comply with all applicable Federal, State, County and City codes, <br /> regulations and adopted standards and pay all applicable fees. <br /> 3. Compliance with these Conditions of Approval is mandatory. Failure to comply with <br /> these Conditions of Approval is unlawful and constitutes a public nuisance and is <br /> subject to the remedies and penalties identified within the SMC, including, but not <br /> limited to, monetary fines and revocation. <br /> 4. All signs shall be subject to approval by the Community Development Department. <br /> The approved use is required to comply with all applicable provisions of the <br /> Stockton Municipal Code, including, but not limited, to the following: <br /> 1 . Structures and other improvements, including exterior paint, must be maintained in a <br /> manner so as not to be blighted or deteriorated (SMC Section 8.36.040). <br /> 2. Any graffiti on the property, including walls and/or fencing, must be removed within <br /> 48 hours (SMC Section 8.24.050). <br /> 3. Any lighting on the site must be shielded so as not to shine onto adjacent properties <br /> (SMC Section 16.32.070). <br /> 2 <br />
