n _ <br /> il <br /> f <br /> l <br /> CITY OF STOCKTON <br /> COMMUNITY DEVELOPMENT DEPARTMENT CITY OF <br /> Use Permit No. P15-158 <br /> ISTOCKTON <br /> 1404 South Fresno Avenue (APN 163-370-18) <br /> On May 20, 2015, the Planning Division approved Use Permit No. P15-158 to authorize <br /> I <br /> the recycling of waste tires into various sized crumb rubber inside an existing structure <br /> at 1404 South Fresno Avenue. The subject includes outdoor storage of tires and <br /> finished tire-derived products. The approval is based on the following Findings of Fact: (� <br /> I <br /> 1. The subject recycling use is allowed in the IG (Industrial, General) zoning district <br /> with the approval of an administrative Use Permit, per Stockton Municipal Code <br /> (SMC) Section 16.20.020, Table 2-2. The proposed use complies with all other <br /> applicable provisions of Title 16 of the SMC, otherwise known as the <br /> "Development Code." <br /> 2. The subject use, as conditioned, would maintain and strengthen the integrity and <br /> character of the neighborhood and IG zoning district because it would re-use an <br /> existing industrial building with a use that is permitted in the subject zoning district. <br /> In addition, the subject use is expected to be of a similar intensity to previously- <br /> approved uses on the site and in the general vicinity. <br /> 3. The subject use is expected to be consistent with the general land uses, <br /> objectives, policies and programs of the General Plan, specifically with the <br /> following General Plan's policies: <br /> LU-5.1: The City shall encourage industrial facilities to locate where municipal <br /> services are available, including adequate sanitary, storm drainage and water <br /> facilities, as well as easy access to multiple modes of transportation; and <br /> LU-5.2: The City shall encourage the clustering of industrial uses into areas that <br /> have common needs and are compatible, in order to maximize their efficiency. <br /> i <br /> 4. The subject site is expected to be physically suitable for the type and <br /> density/intensity of use being proposed including the provision of services (e.g. <br /> sanitation and water), public access and the absence of physical constraints (e.g. <br /> earth movement, flooding, etc.), because the site is located within an established <br /> industrial neighborhood that provides adequate access and services and is not <br /> hindered by physical constraints. <br /> 1 <br />
