ENVIROMVIENT HEALTH <br /> Attn: Charles Metzinger <br /> PERMIT/SERVICES <br /> 1326 North Market Blvd. <br /> Sacramento, CA 95834-1912 <br /> Gentlemen/Ladies: <br /> As you know, we've reached an impasse on the underground clean up at 515 w. <br /> Charter Way in Stockton, CA. <br /> A few years back I agreed to let your company bill the State Water Resource <br /> Control Board directly for your work on this clean-up project. I paid you and you took it <br /> from there. As time went by our account kept dwindling. I had no clue as to why, until I <br /> found out that the State had stopped paying for the rent of the soil vapor extraction unit. <br /> It turns out that the State, after paying for the full value of the soil vapor <br /> extraction device they, and rightly so, discontinued paying "rent" even though Shaw <br /> continued to bill for it. Unbeknown to me, I continued to pay the full amount of each <br /> invoice. <br /> I have contacted others including State Water resources and my attorney, and all <br /> agree that I should not pay what the State has declared a superfluous charge. <br /> Since operation and maintenance of this unit is billed separately, Shaw would not <br /> be "writing off' any direct expense to them, but simply deleting an unjust bill. The sum <br /> amount of this excess rental charge appears to be $41,400.00. <br /> To add to my dismay we are not much further along in this clean-up operation <br /> than when it was started nearly fifteen years ago. It appears that this project has <br /> become a cash-cow for Shaw Environmentai & infrastructure Inc. <br /> The Frank & Rose Rodgers estate is committed, with the help pf the State Water <br /> Resources to clean up the soil & water at this site, and seeks the spirit of fairness and <br /> compensation from Shaw and the San Joaquin Environmental agency in reaching this <br /> goal. <br /> Res ectfully, <br /> Do Rodgers <br />
