c) properly storing, removing from the Property, and disposing of any hazardous or solid waste generated during the work; and d) removing the Well when it is no longer necessary as determined or authorized by the governmental agency responsible for administering the federal and/or state underground storage tank laws and regulations ("UST Agency"), but in no event later than five (5) years after the date of this License, unless such time period is extended by written agreement of the parties. This License will terminate when the Well has been removed and SHELL has met all of its obligations below. 2. SHELL's Work Under This License. SHELL agrees as follows: a) SHELL will perform its work on the Property in a good and workmanlike manner, and will keep the Well in good maintenance and repair while they are installed on the Property. SHELL will exercise its rights and perform its work under this License In compliance with all applicable laws, regulations and the orders of the UST Agency and any other governmental agency having authority over the work. b) SHELL will give written notice to McDonald's and Lessee at least ten (10) days before beginning any installation, maintenance, sampling or removal work on the Well, which notice.will specify the Work to be performed and a date when the work will be completed. c) Immediately after SHELL completes any work on the Wells, SHELL will restore the surface of the areas SHELL disturbs in completing the work to substantially the same or better condition as it was in before SHELL began the work, and will remove all of its equipment, tools, waste, trash and debris from the Property. Upon the termination of this License, SHELL shall remove the Wells and restore the surface of the Well areas to substantially the same or better condition as they were in before SHELL began the work. d) SHELL will not move, remove or demolish any of McDonald's signs, access drives, curbing or other improvements on the Property. If McDonald's future construction needs require the relocation of any of the Wells, SHELL will remove or relocate the Well at a time and location agreed to.by the parties. e) SHELL will separate by cones or other construction safety barriers the areas surrounding the Well while SHELL performs any work in these areas. SHELL will not park on or store any construction vehicles, equipment or materials on the Property when work on the Well is not actively in progress.
