SHELL will not <br /> perform any work during any day of the week between the following hours: 7:00 <br /> a.m. — 10:00 a.m., 11:30 a.m. — 1:00 p.m., and 5:00 p.m. — 7:00 p.m. At all other <br /> times during Business Hours when work is being performed, SHELL will not <br /> unreasonably disrupt the operation of the McDonald's restaurant on the Property, <br /> will block no more than two parking stalls at any one time, and will not block in <br /> any manner more than half of any access drive at any time, maintaining at least <br /> one lane open in each access drive for vehicular traffic. Notwithstanding the <br /> foregoing, SHELL will not perform any work in any drive-thru lane at any time <br /> during business hours. <br /> g) SHELL will perform all of its work under this License at its own expense, <br /> and will not allow any mechanics' lien to be placed on the Property. McDonald's <br /> is not required to perform any activity or incur any expense for any purpose <br /> under this License. <br /> 3. Sampling Results. Upon the request of McDonald's, SHELL will provide <br /> McDonald's (at the address listed in Section 7 of this License) with a copy of all <br /> sampling results taken from the Well and a copy of any environmental report <br /> based in whole or part on the sampling results. <br /> 4. Indemnity. SHELL will indemnify, defend and hold harmless McDonald's from <br /> and against any and all losses, damages, causes of action, claims, liabilities and <br /> expenses (collectively "Claims") (including reasonable attomeys' fees and court <br /> costs) arising out of or in connection with, directly or indirectly, the installation, <br /> maintenance, sampling, removal or existence of the Well or the entry onto the <br /> Property by SHELL, its subsidiaries, affiliates, agents, contractors or employees, <br /> including without limitation, those arising from mechanics' liens, injury to persons <br /> or damage to property. In the event of any such Claim, McDonald's shall <br /> promptly notify SHELL regarding the Claim, including forwarding any written <br /> correspondence, court filings or other documents. <br /> 5. Property Condition. SHELL accepts the Property in an "as-is" condition, without <br /> any warranty or representation by McDonald's. During the term of this License, <br /> SHELL shall be responsible for maintaining the safety of SHELL's employees <br /> and contractors who enter the Property to perform any activities hereunder on <br /> behalf of SHELL. While performing any activities on the Property pursuant to this <br /> License, SHELL shall take appropriate safety measures (such as erecting safety <br /> cones or temporary barricades around SHELL's immediate work areas) to <br /> minimize risks to persons or property. <br /> 6. Default. If SHELL defaults under this License and continues in default for thirty <br /> (30) days after SHELL receives written notice of such default from McDonald's, <br /> then McDonald's may terminate SHELL's right of access to the Property.
