f
this facility by this office." In the corresponding Violation checklist, a check was placed
next to "CCR 2712(b) Maintenance & monitoring records."
Response: BP has a strong commitment to full compliance with the laws, regulations
and permit conditions that govern the operation of its facilities. We have instructed the
lessee -dealer at this facility to conduct a daily visual inspection of the UST monitoring
system and to maintain a log of his observations. A copy of my May 21, 2003 letter to
the lessee -dealer is enclosed. The lessee -dealer has assured us that he is now maintaining
a log of daily visual inspections.
3. Alleged Violation: The UST Program Inspection Report stated that "Annual line
tightness test must be done at this facility because it does not satisfy CCR 2636(g). The
line tightness test is being performed today. Submit results to this office by 5-23-03." In
the corresponding Violation checklist, a check was placed next to "CCR 2636(f)(4)
Annual line tightness test."
Response: As noted in the Inspection Report, a line tightness test was performed at the
facility on the day of the inspection. By conducting a line test on April 23, 2003, BP
complied with the requirements of section 2636(f)(4) of Title 23 of the California Code
of Regulations. All lines passed the test. As requested, a copy of the test results are
enclosed with this letter. Copies of these test results have been sent to the facility for
their records.
With the transmittal of this letter, it is our understanding that the above-mentioned
alleged violations associated with this routine inspection conducted on April 23, 2003 has
been resolved. If this is not correct, please contact me as soon as possible. If you have
any questions regarding the enclosed documents, or if further action is required by
BP/ARCO, please contact me at (800) 525-5857 x6233.
sv,
'ompliance Specialist
BP West Coast Retail Business Unit
Enclosures
cc: File 5469
Deborah Felt
Lisa Wing Stone
