Mr. John Welch -2- 24 Nfay 1995 <br /> The May 1995 letters state that the property owners will not proceed with implementation of the <br /> work plan until they have been approved to receive funds through the State Underground Tank <br /> Cleanup Fund. As you know, these cleanup funds are given only for work directly associated <br /> with contamination resulting from underground storage tanks. In addition to the underground <br /> tank and old leachfield problem, contamination also has recently been discovered which is the <br /> result of aboveground storage tank spills and/or leaks at the site. Furthermore, some of the soil <br /> contamination at the site may also be the result of contaminated ground water fluctuating up and <br /> down in the vadose zone. Therefore, it is unlikely that the State will be reimbursing your clients <br /> for much of the work required to be done at the site. Another important fact to consider is that <br /> the State only reimburses those parties which are in full compliance with the Board's <br /> requirements. <br /> In our recent phone conversations, you have reassured me that the property owners fully intend <br /> to implement the approved work plan. You have stated that the delay in implementing the work <br /> plan is necessary because in order to be considered by the State for cleanup funds, pre-approval <br /> is necessary prior to implementing any work. It is disheartening that the property owners did not <br /> aggressively pursue these issues more than six months ago while the work plan was being <br /> developed and underground tanks were discovered. Regardless, your request for an extension to <br /> submit the investigative report to 1 August 1995 is hereby approved. However, any further <br /> delays will be cause for me to recommend an enforcement order.
