• <br /> RIGHT OF ENTRY AGREEMENT <br /> t <br /> JM EQ IPMENT (tenant) and GEO PROPERTIES, INC. , a California <br /> ' Corporation (owner) , as Permittors, hereby grant permission to <br /> MILES & NOLET, as Permittee, to install and from time to time <br /> sample one (1) two (2) inch diameter monitoring well on the <br /> property at 1245 W. Charter Way in the City of Stockton, State <br /> ' of California. <br /> The monitoring well will be located along the easterly <br />' portion of the yard area at a mutually acceptable location <br /> approved by Public Health Services of the County of San Joaquin. <br />' The well will be covered with a flush-mounted sealed cover <br /> about twelve (12) inches in diameter which can sustain vehicle <br /> traffic. <br />' For the period and in the frequency required by the regulators, <br /> the well will be sampled. Test results will be provided by <br /> Permittee to Permittors . <br /> Except during the initial installation, final abandonment <br /> and any relocation requested by Permittors , the entry will be <br /> limited to taking samples . <br />' Permittee agrees to leave the site neat and clean and to <br /> remove all soil and water produced from its operations . <br /> Permittee agrees to pay the entire cost of the borings and <br /> monitoring wells, testing and abandonment of the borings and wells <br />' including restoration of the monitoring well site . Permittee <br /> will provide to Permittors copies of all test results . <br /> Permittee agrees to hold Permittors free and harmless from <br />' all costs , c:lalrns and expense 3.ncludi.zg reasonable attorney ' c; <br /> fees arising out of Permxttee ' s entry as permitted hereby. <br />' Permittee will see that its consultants and contractors <br /> will coordinate with Permittors as to the specific location <br /> of any borings and wells. <br />' This right of entry will extend for a period of two (2) <br /> years from the date hereof provided that Permittors may terminate <br /> this right of entry at any time upon six (6) months prior written <br /> notice to Permittor. Upon termination, permittee will abandon <br />
