• RIGHT OF ENTRY AGREEMENT t JM EQ IPMENT (tenant) and GEO PROPERTIES, INC. , a California ' Corporation (owner) , as Permittors, hereby grant permission to MILES & NOLET, as Permittee, to install and from time to time sample one (1) two (2) inch diameter monitoring well on the property at 1245 W. Charter Way in the City of Stockton, State ' of California. The monitoring well will be located along the easterly ' portion of the yard area at a mutually acceptable location approved by Public Health Services of the County of San Joaquin. ' The well will be covered with a flush-mounted sealed cover about twelve (12) inches in diameter which can sustain vehicle traffic. ' For the period and in the frequency required by the regulators, the well will be sampled. Test results will be provided by Permittee to Permittors . Except during the initial installation, final abandonment and any relocation requested by Permittors , the entry will be limited to taking samples . ' Permittee agrees to leave the site neat and clean and to remove all soil and water produced from its operations . Permittee agrees to pay the entire cost of the borings and monitoring wells, testing and abandonment of the borings and wells ' including restoration of the monitoring well site . Permittee will provide to Permittors copies of all test results . Permittee agrees to hold Permittors free and harmless from ' all costs , c:lalrns and expense 3.ncludi.zg reasonable attorney ' c; fees arising out of Permxttee ' s entry as permitted hereby. ' Permittee will see that its consultants and contractors will coordinate with Permittors as to the specific location of any borings and wells. ' This right of entry will extend for a period of two (2) years from the date hereof provided that Permittors may terminate this right of entry at any time upon six (6) months prior written notice to Permittor. Upon termination, permittee will abandon
