Failed to file an exception report. A generator shall submit an Exception Report to the Department <br /> of Toxic Substance Control if the generator has not received a copy of the manifest with the handwritten <br /> signature of the owner/operator of the designated facility within 45 days of the date the waste was <br /> accepted by the initial transporter. Exception Report shall include' copy of manifest for which the <br /> generator does not have confirmation of delivery and a cover letter by the generator/generator's <br /> authorized representative explaining the efforts taken to locate the hazardous waste and the results of <br /> those efforts. Correct by submitting a statement of how this will be conducted. <br /> # 84. Storage of Universal Waste fluorescent tubes on-site for an undetermined amount of time. Per <br /> David and Jodee, approximately 40+ of waste fluorescent tubes are on-site because do not know of any <br /> designated hazardous waste facility to take them in. Universal Waste, ie. Batteries, lamps, mercury <br /> containing equipment, electronic devices, CRTs, CRT glass, can remain on-site for up to 1 year in a <br /> closed container that prevents breakage and release into the environment with a label that identifies the <br /> waste. Correct by properly disposing the Universal Waste at a designated hazardous waste facility. <br /> Submit a copy of the disposal receipt to SJC EMD within 30 days (08/27/10). <br /> Submit to SJC EHD within 30 days: <br /> 1, one copy of the Return to Compliance Certification <br /> 2. a corrective action statement for the above violations <br /> 3. requested/supporting documentations <br /> Notes: <br /> • Provided facility a Small Business Hazardous Waste Disposal Program brochure for the disposal <br /> of Universal Waste <br /> • One 500 gallon of used oil tank latest pickup was 07/09/2010. It had an incorrect start <br /> accumulation date of 07/09/2010. The previous pickup was 12/30/2009 so the correct initial start <br /> accumulation date for the latest pickup should have been 01/2010. Hazardous waste can remain <br /> on-site for up to 180 days = 6 months of initial start accumulation date. <br /> • Cast record copy on file with SJC EHD of oil-water separator sludge removed was 12/20/2001. <br /> Uniform Hazardous Waste Manifest#21154546 stated American Valley Waste Oil had removed <br /> 950 gallons of non-RCRA hazardous waste liquid (oily-water). <br /> ALL.EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE(5115). <br /> THIS FACILITY IS SUBJECT TO REINSPEC AT ANY TIME ATE Q'S CURRENT HOURLY RATE. <br /> EHDInspector.T Y Titl <br />
