California Reonal Water Quality Atrol Board
Central Valley Region
Robert Schneider,Chair
Terry Tamminen Arnold Schwarzenegger
Secretary for Sacramento Main Office Governor
Environmental Internet Address: http://w .swreb.ca.gov/mgcb5
Protection 11020 Sun Center Drive#200 Rancho Cordova,CA 95670-6114
Phone(916)464-3291 C
-c
i
13 May 2004
Mr. James Fisk ztf
J&L Market
8125 E1 Dorado Street
French Camp,CA 95231 w —
NON-COMPLIANCE,J&L MARKET, 8125 S. EL DORADO ST., FRENCH CAMP,
SAN JOAQUIN COUNTY
On 31 December 2003,I approved your 25 November 2003 Workplan for Further Groundwater Investigation
(Workplan),to install the additional groundwater monitoring wells requested in my letter of 10 October 2003.
Subsequently I reviewed the 4 May 2004 First Quarter 2004 Report(Report),prepared on your behalf by
Upgradient Environmental Consultants(UEC). Page 4 of the Report states: "The Regional Water Quality
Control Board has requested the RP to install additional monitoring wells to more fully define the limits of
groundwater contamination. This work has been delayed until Mr. Fisk receives reimbursement from the State
UST Cleanup Fund for the work that was completed during the first half of 2003. The Fund requested revised
documentation pursuant to the February 2003 reimbursement request. The revised documents were submitted in
July 2003, but full payment has not been received."
All three monitoring wells at the site are impacted by groundwater contamination. Additional monitoring wells
are necessary to complete lateral definition of the groundwater plume. I recognize the economic importance of
receiving CUF monies, however, execution of work directed by Regional Board staff is not contingent upon prior
CUF payment. Therefore you are directed to complete installation of the additional groundwater monitoring
wells no later than 1 July 2004 per the approved Workplan. Failure to comply with this directive may result in
formal enforcement action and/or denial of your CUF eligibility.
I discussed the status of your CUF claim with Mark Owens of the CUF. Mr. Owens reviewed the file for your
site, and stated that an invoice from a subcontractor does not appear to be related to this site. Your claim is
pending until the correct invoice is submitted. Mr. Owens suggests that you contact Linda Sanborn, CUF (916)
341-5768 to receive additional assistance and clarification on your claim.
The Report also states:
• Groundwater flow direction was southwest for the first time since monitoring began in June 2002.
• Methyl tert-Butyl Ether(MtBE, 26 µg/L) and tert-Butanol Alchohol (TBA, 11 µg/L)have migrated into
downgradient monitoring well JLM-4.
• "Which laboratory's EPA 8015A data are more accurate is unknown." When UEC changed laboratories
(labs) this last quarter, the concentration data showed a rise in levels of contaminants. In the
Recommendations section,UEC requests that next quarter's groundwater samples be sent to three
separate labs,McCampbell Analytical Inc.(McCampbell),Exochem Analytical Laboratories (Exochem),
and an unspecified lab,for comparison.
California Environmental Protection Agency
rLa Recycled Paper
