Used aerosol paint cans are being disposed into trash without first determining if the waste is a <br /> hazardous waste. Used aerosol cans typically are still pressurized with some residuals of flammable <br /> propellant. Any person who generates a waste shall determine if the waste is a hazardous waste. <br /> Immediately stop disposing used aerosol cans into trash, make a hazardous waste determination and <br /> manage it as appropriate. Submit a statement and supporting documentation explaining how this waste <br /> was managed by November 8, 2013. <br /> Minor Notice to Comply: <br /> 301. Oily staining was observed around the oil drain rack (located inside the repair shop), the secondary <br /> containment of the drain rack was full of oily liquid, surface staining was observed around the adjacent 5- <br /> gallon oil containers which had some pourable amount of oily fluid. Facilities shall be maintained and <br /> operated to minimize the possibility of a fire, explosion, or release of hazardous waste to air, soil, or <br /> surface water which could threaten human health or the environment. During the inspection the facility <br /> drained the secondary containment of the oil drain rack, used the site's spill kit to soak up the spilled oil, <br /> disposed all the oily waste into the site's above ground used oil tank and stored used absorbent pending <br /> proper disposal.
