Hazardous <br /> waste generators shall retain copies of all manifests for three years or until a copy signed off by the destination <br /> facility is received. The signed off copy shall be retained and made readily available for review for three years. If <br /> the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the <br /> facility to which the generator's waste was submitted within 60 days of the date the waste was accepted by the initial <br /> transporter,the generator shall submit a legible copy of the missing manifest,with some indication that the <br /> generator has not received confirmation of delivery. This information shall be submitted to: <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifests or prepare and submit the required information to DTSC. <br /> Submit to the EHD a copy of the signed off copy of the manifests or a copy of the information submitted to DTSC. <br /> This is a Class II violation. <br /> 119 HSC 25404(e)(4) Failed to report program data in the California Environmental Reporting System (CERS). <br /> A submission to the California Electronic Reporting System (CERS)for the hazardous waste program has not been <br /> made. Beginning January 1,2013, all businesses are required to submit all new(or any changes to existing) <br /> hazardous waste information online to the CERS at http://cers.calepa.ca.gov. Be sure to include your hazardous <br /> waste activity in the Businesses Activities section in CERS in addition to any other relevant activities and required <br /> fields. <br /> This is a Class II violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> Oily staining was observed on the ground near the east side of the fence where old oil containers were located. <br /> An oily puddle was observed on the ground near three 55 gallon drums on the east side of the backyard. <br /> One paper and two metal used oil filters were observed on top of two 55 gallon drums on the east side of the <br /> backyard. <br /> Saturated oily absorbent was observed on the ground at the base of a 55 gallon steel drum that held used oil. The <br /> drum was located near the exit of the backyard into the shop. <br /> Facilities shall be maintained and operated to minimize the possibility of a fire,explosion,or release of hazardous <br /> waste to air, soil, or surface water which could threaten human health or the environment. Immediately clean the <br /> above wastes and manage them according to Title 22 hazardous waste regulations. Submit a statement and <br /> supporting documentation explaining how these wastes were managed. <br /> This is a minor violation. <br /> 406 CCR 66261.7 Contaminated container not marked with date emptied or managed within one year of being emptied. <br /> One blue 55 gallon steel drum that contained used oil was observed without an empty label. Containers larger than <br /> five gallons that previously held a hazardous material shall be marked with the date they were emptied and <br /> managed within one year of being emptied.
