Code Regs.: At the time of inspection, one drum containing hazardous waste was stored without a lid. This drum contained a dried paint sludge residue. Sample results revealed the sludge to contain lead at 4,810 parts per million (ppm). This exceeds the TTLC value for lead, which is 1000 ppm. II. Schedule of Correction Violation #1: EFFECTIVE IMMEDIATELY, Ad -Art shall cease disposing of the paint sludge to the sanitary landfill. All paint sludge shall be disposed of as hazardous waste in accordance with all applicable laws and regulations. An order form to obtain a copy of the laws and regulations has been enclosed. Violation #2a: Within 60 days of receipt of this Report, Ad -Art shall dispose of all empty drums. The drums may either be disposed of as hazardous waste; reused by the manufacturer, recycled by a drum recycler; or triple - rinsed, crushed, and sent to the sanitary landfill. If triple -rinsed, the rinsate must be managed as hazardous waste unless tested and proven non -hazardous. Any tests must be conducted at a lab accredited by the State of California to perform hazardous waste criteria tests. Violation #2b: Within 30 days of receipt of this Report, all drums containing hazardous waste shall be disposed of. They must be transported by a registered hazardous waste transporter utilizing a Uniform Hazardous Waste Manifest. All hazardous waste must be transported to a DHS approved facility. If the hazardous waste is to be transported to another state, the receiving facility must have been granted authority to operate by either the EPA or the state's administering agency. Violation #3: Within 15 days of receipt of this Report, a hazardous waste determination shall be made for the waste paint sludge generated by the spray paint booth exhaust system.
