Since additional violations are cited in the attached inspection report, you are required by section 25185 (c)(3) of the Health and Safety Code to submit a written response to the Department within 30 days from the receipt of this letter on their compliance. Within 30 days of receipt of this letter, Tri -Valley Recycling shall submit documentation/evidence, as detailed in the "Violations" section of the enclosed inspection report, regarding corrective actions taken by Tri -Valley Recycling to correct the additional cited violations. Please be advised that California Health and Safety Code, section 25185, subdivision (c)(3) requires that you submit a written response to DTSC within 30 days of receipt of this letter. The written response shall include a detailed description of the corrective actions that Tri -Valley Recycling has taken to bring its facility into compliance. If Tri -Valley Recycling disputes any of the violations, Tri -Valley Recycling should explain its disagreement in this written response. In accordance with California. Code of Regulations, title 22, section 66272.65, et seq., each day that a violation continues is considered a separate and distinct violation, and DTSC may assess additional penalties for each day that a violation continues. The issuance of this letter does not preclude DTSC from taking administrative, civil, or criminal action as a result of the violations noted in this letter and in the inspection report. All of the information that DTSC has requested in this letter is requested pursuant to California Health and Safety Code section 25185.6, which gives DTSC the authority to require any person who owns or operates a hazardous waste facility, or who generates hazardous waste, to furnish any existing information relating to hazardous substances, hazardous wastes, or hazardous materials. All pertinent information derived from the inspection, including photographs are included in the report. This report will become a public document; you may request that any trade secret or facility security information be withheld from public disclosure. (See California Health and Safety Code section 25173.) If you wish to assert the trade secret privilege after you have reviewed the report, please provide specific answers to each of the following questions for each item: ■ To what extent is there knowledge of the information conveyed by the photograph/document outside of your business? ■ To what extent is there knowledge of the information conveyed by the photograph/document, by employees and others in your business?
