Complaint Investigation Rep <br />III VIOLATIONS <br />Tri -Valley Recycling <br />A Summary of Violations was issued to Tri -Valley Recycling, following the inspection on <br />April 19 and 20, which contained the following violations and corrective actions: <br />Class I Violations: <br />Violation 1: on or about April 19, 2011, Tri -Valley Recycling violated California <br />Code of Regulations, title 22, section 66262.12(a) in that Tri -Valley Recycling <br />transported and stored hazardous waste without an EPA Identification Number. <br />Tri -Valley Recycling transported lead acid batteries from households to their <br />facility without first obtaining an EPA ID number. <br />Corrective Action: Please obtain an EPA ID number, and submit the ID number <br />to DTSC within next 30 days of date of inspection. <br />Status: Incomplete. Facility submitted the tracking number CUW000000148, <br />issued to Tri -Valley Recycling on June 30, 2009, that is used by DTSC for <br />tracking and recording e -waste recycling facilities. The number CUW000000148 <br />is not a hazardous waste generator EPA ID number. Please follow instructions <br />given on the DTSC web page and apply for an EPA ID number. To assist Tri - <br />Valley Recycling in the process of applying for an ID number, a fact sheet named <br />"EPA ID Numbers for Generators" is included with this report. <br />Violation 2: On or about April 19, 2011, Tri -Valley Recycling violated California <br />Code of Regulations, title 22, section 66266.81 in that the facility transported <br />lead acid batteries without a manifest or bill of lading. <br />Corrective Action: Tri -Valley recycling must immediately stop the transport of <br />lead acid batteries without a manifest or bill of lading. Within 30 days of date of <br />inspection, please send the method by which Tri -Valley Recycling will prevent <br />the reoccurrence of this violation. <br />Status: Complete. Tri -Valley Recycle has written to DTSC that the facility will <br />stop collecting batteries. <br />Violation 3: On or about April 19, 2011, Tri -Valley Recycling violated Health and <br />Safety Code, section 25201(a) in that the facility stored hazardous waste without <br />permit or grant of authorization. Tri -Valley Recycling stored multiple lead acid <br />batteries, alkaline batteries and carbon- zinc batteries in multiple containers <br />without authorization for an extended period of time. <br />Corrective Action: Please manifest all stored batteries to a disposal facility and <br />send a copy of the manifest to DTSC within 30 days of date of inspection. The <br />batteries must be transported by an authorized hazardous waste transporter with <br />an EPA ID number to an authorized disposal facility that has an EPA ID number. <br />Status : Complete Tri -Valley Recycling failed to obtain a generator EPA ID <br />number and did not use a manifest to dispose the stored batteries. The facility <br />used the reduced requirements for management of spent lead acid batteries as <br />outlined by California Code of Regulations, title 22, section 66266.81 to dispose <br />17 of 20 <br />
