Complaint Investigation Rep <br />Tri -Valley Recycling <br />the batteries. Tri -Valley Recycling employed American Battery Company to <br />transport 5,720 lbs of junk lead acid batteries from Tri -Valley Recycling to an <br />EPA approved battery recycler. Tri -Valley Recycling mailed to DTSC a bill from <br />American Battery Company. <br />Class II Violations: <br />Violation 4: On or about April 19, 2011, Tri -Valley Recycling violated California Code of <br />Regulations, title 22, section 66266.81 (a)7 in that the facility failed to store the batteries <br />with the date they were received in ink or paint, or other weather resistant material <br />such that the date is legible and conspicuous. <br />Corrective Action: Tri -Valley Recycling must label the boxes of batteries with <br />the date the first battery was received. Within 30 days of date of inspection, <br />please send to DTSC the photographic proof to show that all battery containers <br />are labeled with the date of receipt. <br />Status: Complete <br />Violation 5: On or about April 19, 2011, Tri -Valley Recycling violated California <br />Code of Regulations, title 22, section 66273.72(c)(2)(C)7 in that the facility failed <br />to maintain aisle spacing in compliance with applicable fire safety code in <br />California. The facility stored containers with CRTs, electronic devices and <br />batteries without adequate aisle space. <br />Corrective Action: Tri -Valley Recycling must maintain adequate isle space with <br />applicable fire code. Within 30 days of date of inspection, please send <br />photographic proof to show that the universal waste containers are stored with <br />adequate isle space. <br />Status: Complete <br />Violation 6: On or about April 19, 2011, Tri -Valley Recycling violated California <br />Code of Regulations, title 22, section 66273.34 in that the facility failed to mark <br />each electronic device container with the phrase "Universal waste — Electronic <br />device". The facility failed to mark each pallet of CRT with "Universal Waste — <br />CRTs." <br />Corrective Action: Please mark each pallet/ container of universal waste with <br />the appropriate marking. Within next 30 days of date of inspection, please send <br />photographic proof to DTSC to show that the universal waste is marked with <br />"Universal waste — Electronic device" or "Universal Waste — CRTs." <br />Status: Complete <br />Violation 7: On or about April 19, 2011, Tri -Valley Recycling violated California <br />Code of Regulations, title 22, section 66273.35 in that the facility failed to <br />demonstrate the length of time the universal waste has been accumulated from <br />the date it became a waste or was received. The facility failed to mark each <br />pallet/ container with the earliest date that any universal waste in the <br />container/pallet became a waste. <br />Corrective action: Please mark each pallet/ container with the date on which <br />18 of 20 <br />
