Complaint Investigation Re, <br />Tri -Valley Recycling <br />the earliest date any universal waste was stored. Within next 30 days of date of <br />inspection, please send photographic proof to DTSC to show that pallets and <br />containers are marked with the first date of accumulation. In addition, please <br />explain how you would prevent a reoccurrence of this violation. <br />Status: Complete <br />Additional Violations Determined: <br />Upon further review, the following violations are now being assessed or revised.- <br />Class <br />evised: <br />Class I Violations: <br />Violation 8 : On or about April 19, 2011, Tri -Valley Recycling violated California Code <br />of Regulations, title 22, section 66262.12(a) in that Tri -Valley Recycling generated and <br />stored waste oil without an EPA Identification Number. <br />Corrective Action: Within 30 days of receiving this report please obtain an EPA ID <br />number by following instruction given on the DTSC web page. Please submit to DTSC <br />the EPA ID number given to Tri -Valley Recycling. A fact sheet named "EPA <br />Identification Numbers for Generators" is included with this report to assist Tri -Valley <br />Recycling in obtaining an EPA ID number. <br />Class II Violations: <br />Violation 9: On or about April 19, 2011, Tri -Valley Recycling violated California Code of <br />Regulations, title 22, section 66262.34(f) and 66266.130 in that the facility failed to label <br />used oil bottles and used oil filters with the name, and address of the generator and the <br />words "Used Oil" or "Drained Used Oil Filters" with the start date of accumulation. <br />Corrective Action: Within next 30 days of the date of this report, please label used oil <br />and used oil filter containers with appropriate labels and send photographic evidence to <br />DTSC. Facts sheets named "Used Oil Generator Requirements" and "Managing Used <br />Oil Filters for Generators" are included with this report to provide information on <br />management of used oil and used oil filters. <br />Violation 10: On or about April 19, 2011, Tri -Valley Recycling violated California Code <br />of Regulations, title 22 section 66273.74(c) in that Tri -Valley Recycling failed to <br />maintain a file in the universal waste handler's facility with the following documents. <br />a. A copy of the notification submitted to the department beginning no later than <br />30 days prior to treating any electronic device <br />b. A copy of the most recent annual report submitted to DTSC <br />c. A current copy of any local district air permit and any other relevant permit <br />required for the facility. <br />Corrective Action: Within 30 days of receiving this report, please submit in writing the <br />method by which Tri- Valley Recycling will prevent a reoccurrence of this violation. <br />19 of 20 <br />
