By the use of <br /> 2 this equipment, SUMIDEN WIRE PRODUCTS' CORPGP.ATION has reduced its <br /> 3 use of hazardous materials, and commenced the generation of <br /> 4 <br /> materials useful in treating hazardous wastes produced by others. <br /> 5 This has produced significant benefit for the community. <br /> 6 5 . Defendant SUMIDEN WIRE PRODUCTS CORPORATION shall pay <br /> 7 $72,137. 50 in generator fees currently unpaid to the County of San <br /> g Joaquin and the California State Board of Equalization. This amount <br /> 9 shall be paid without protest or reservation on or before January <br /> 10 15 , 1993 . <br /> 11 6 . Defendant SUMIDEN WIRE PRODUCTS CORPORATION and J.R. <br /> 12 SIMPLOT COMPANY shall jointly reimburse the investigation costs of <br /> 13 the San Joaquin County District Attorney and the State of California <br /> 14 Department of Toxic Substances Control the total amount of which is <br /> 15 determined to be $20,000 . Apportionment has been determined by <br /> 16 SUMIDEN and J. R. SIMPLOT. Payment of said costs shall be--made <br /> 17 contemporaneously with the entry of this Judgment, as follows: <br /> 18 San Joaquin County District Attorney: $15 ,000 . <br /> 19 Department of Toxic Substances Control : $5,000 . <br /> 20 7. In full and final discharge and satisfaction of all <br /> 21 allegations in the complaint and specifically of violation of Title <br /> 22 22 of the California Code of Regulations Sections 6605 and 66508 , <br /> 23 pursuant to Health and Safety Code 25189 .2(b) , defendants SUMIDEN <br /> 24 WIRE PRODUCT'S CORPORATION and J.R. SIMPLOT COMPANY shall jointly pay <br /> 25 a total of $100 ,000 in civil penalties. Apportionment has beep <br /> 26 determined by SUMIDEN and J.R. SIMPLOT.
