After inquiry, DTSC referred the case to the San <br /> 3 Joaquin County District Attorney (the "DA" ) for enforcement. <br /> 4 3 . During June and July 1991 , Sumiden and the DA <br /> 5 held extensive meetings . In addition , later that summer, <br /> 6 representatives of DTSC and Sumiden met to discuss Sumiden' s <br /> 7 manufacturing process , and issues of classification and <br /> 8 quantity of Ferrorich and Ferrozinc. Simplot, the <br /> 9 fertilizer manufacturer, provided documents detailing the <br /> --10 exact quantity of materials received from Sumiden. Sumiden <br /> 11 provided original documents and summaries showing the <br /> 12 amounts and types of materials shipped . The DA conducted <br /> 13 inspections of. Sumiden and of Simplot. when contacted by <br /> 14 the DA concerning the amount of generator fees paid , and any <br /> 15 amounts under protest, the Board responded by transmitting a <br /> 16 payment history and account balances but too}: no other <br /> 17 action. <br /> 18 4 . In August 1992 , the parties reached a <br /> 19 settlement. <br /> 20 5 . Thereupon , as requested by DTSC , the DA filed <br /> 21 the complaint initiating this action . The complaint alleged <br /> 22 violations of Chapter 6 . 5 of Division 20 of the Health & <br /> 23 Safety Code (commonly }mown as the "Hazardous Waste Control <br /> 24 Law" ) and regulations promulgated thereunder , relating to <br /> 25 generators and facilities . <br /> 26 6 . Pursuant to a stipulation between the People <br /> 27 and the Defendants , this Court entered a judgment on <br /> 28 <br />
