CIVIL PENALTIES , SUPPLEMENTAL ENVIRONMENTAL PROJECTS AND <br /> 2 COSTS <br /> 3 5 . 1 Civil Penalties <br /> 4 Within twenty- one (21 ) business days after entry of this Final Judgment, Defendant shall pay <br /> 5 SEVEN HUNDRED AND EIGHTY-SEVEN THOUSAND FIVE HUNDRED DOLLARS <br /> 6 ($787 , 500 . 00) as civil penalties pursuant to Health and Safety Code sections 25189 and 25515 , and <br /> 7 Business and Professions Code section 17206 and Government Code section 26506, to be distributed <br /> 8 to the prosecuting agencies/regulatory agencies identified in, and in accordance with, the terms of <br /> 9 Exhibits B4 and B-2, attached and made part of this Final Judgment on Consent by this reference. <br /> 10 5 .2 Supplemental Environmental Proiects <br /> 11 Within twenty-one (21 ) business days after entry of this Final Judgment, Defendant shall pay <br /> 12 ONE HUNDRED AND TWELVE THOUSAND FIVE HUNDRED DOLLARS ($ 112, 500 . 00) for <br /> 13 supplemental environmental projects identified in, and in accordance with the terms of Exhibit C, <br /> 14 attached. <br /> 15 5 . 3 Hazardous Waste Minimization and Enhanced Compliance Proiects <br /> 16 Defendant shall continue toimplement, for a period of no less than five (5) years after the <br /> 17 Effective date of the Final Judgment, projects to reduce hazardous waste generation and enhance the <br /> 18 performance of Defendant' s hazardous waste management in California, including but not limited to <br /> 19 the specific projects identified in paragraphs 4 .4 .a. (Compliance Consultant), 4 .4 .b . (Defendant' s <br /> 20 Compliance Program — Written Policies and Procedures), 4.4 . c. (Training Records), 4 .4 . d. <br /> 21 (Defendant' s Compliance Program — California Environmental Compliance Employee), 4 .4 . d. <br /> 22 (Defendant' s Compliance Program — Employee training and education), and 4.4 . e. (Handheld <br /> 23 Scanners) . <br /> 24 5 .4 Reimbursement of Costs of Investigation and Enforcement <br /> 25 Within twenty-one (21 ) business days after entry of this Final Judgment, Defendant shall pay <br /> 26 TWO HUNDRED AND SIXTY THOUSAND DOLLARS ($260, 000 . 00) for reimbursement of <br /> 27 attorney' s fees, costs of investigation, and other costs of enforcement, to the entities identified in, <br /> 28 and in accordance with the terms of, Exhibits D-I and D-2, attached. <br /> I1 <br /> f <br /> STIPULATION FOR ENTRY OF FINAL JUDGMENT AND PERMANENT INJUNCTION <br />
