substances, and also shall be capable of storing the hazardous substances for the maximum <br /> anticipated period of time necessary for the recovery of any released hazardous substance. <br /> 4 Failures from the March 22, 2006, secondary containment testing have not been <br /> addressed at the Manthey Road facility. <br /> 4 Failures from the March 21, 2006, secondary containment testing have not been <br /> addressed at the Wilson Way facility. <br /> HSC 25291 (e) Water in secondary containment. If water could enter into the secondary <br /> containment by precipitation or infiltration, the facility shall contain a means of monitoring for <br /> water intrusion and for removing the water by the owner or operator. The regulations shall <br /> include a schedule that requires that financial responsibility requirements are phased-in for <br /> all underground storage tank systems on or before October 26, 1990. <br /> (b) If the owner and the operator are separate persons, either the owner or the operator shall <br /> demonstrate compliance with subdivision (a). <br /> (c) An owner may comply with this article by entering into an agreement with the operator of the <br /> tank requiring the operator to demonstrate compliance with subdivision (a). However, both <br /> the owner and the operator are in violation of subdivision(a) if evidence of financial <br /> responsibility is not established and maintained in accordance with this article. <br /> 4 The Airport Way facility did not submit a current certification of financial <br /> responsibility for the 2004-2005 fiscal year. <br /> —> The Cherokee Lane facility did not submit a current certification of financial <br /> responsibility for the 2005-2006 fiscal year. <br /> 4 The Manthey Road facility did not submit a current certification of financial <br /> responsibility for the: <br /> 4 2002-2003 fiscal year in a timely manner <br /> 4 2003-2004 fiscal year in a timely manner <br /> 4 2005-2006 fiscal year <br /> 4 The Wilson Way facility did not submit a current certification of financial responsibility <br /> for the: <br /> Page 12 of 20 <br />
