Each owner or operator shall have a <br /> contingency plan for the facility. The contingency plan shall be designed to minimize hazards to <br /> human health or the environment from fires, explosions, or any unplanned sudden or non-sudden <br /> release of hazardous waste or hazardous waste constituents to air, soil, or surface water. <br /> -) The Cherokee Lane facility did not have a contingency plan at the time of the January <br /> 20, 2006, hazardous waste inspection. <br /> --) The Wilson Way facility did not have a contingency plan at the time of the January 16, <br /> 2003, hazardous waste inspection. <br /> Title 22, CCR 66265.55 No emergency coordinator. At all times, there shall be at least one <br /> employee either on the facility premises or on call (i.e., available to respond to an emergency by <br /> reaching the facility within a short period of time) with the responsibility for coordinating all <br /> emergency response measures. This emergency coordinator shall be thoroughly familiar with all <br /> aspects of the facility's contingency plan, all operations and activities at the facility, the location <br /> and characteristics of waste handled, the location of all records within the facility, and the <br /> facility layout. In addition, this person shall have the authority to commit the resources needed to <br /> carry out the contingency plan. <br /> -) The Cherokee Lane facility did not have an emergency coordinator at the time of the <br /> January 20, 2006, hazardous waste inspection. <br /> Underground Storage Tank Violations <br /> HSC 25284.2 Annual spill containment testing. The owner or operator of an underground <br /> storage tank with a spill containment structure designed to prevent a release in the event of a spill <br /> or overfill while a hazardous substance is being placed in the tank shall annually test the spill <br /> containment structure to demonstrate that it is capable of containing the substance until it is <br /> detected and cleaned up. <br /> 4 The Airport Way facility was approximately one month late for the annual spill bucket <br /> testing. Testing was due by May 2005 and was not performed until June 6, 2005. <br /> 4 The Cherokee Lane facility was approximately five months late for the annual spill <br /> bucket testing. Testing was due by September 2005 and was not performed until February <br /> 21, 2006. <br /> 4 The Manthey Road facility was approximately one month late for the annual spill <br /> bucket.
