Box 8130 <br /> Stockton, CA 95208-0106 <br /> Dear Mr. Wykoff: <br /> UNDERGROUND STORAGE TANK (UST) LOCAL OVERSIGHT PROGRAM, SITE NOS. 1988 AND <br /> 24126, SAN JOAQUIN AND MERCED COUNTIES <br /> We have received your letter dated June 24, 1991 regarding our UST Cleanup <br /> Site Invoices for the above two sites. We understand your frustration <br /> regarding the costs included in the subject invoices and will provide <br /> additional information regarding the way in which the oversight costs are <br /> allocated to the sites. <br /> Both Health and Safety Code Sections 25297.1 and 25360 provide authority for <br /> the State Water Resources Control Board (State Board) to recover costs <br /> expended in the Local Oversight Program. We have enclosed a copy of <br /> Resolution 88-23 dated February 18, 1988 which includes cost recovery <br /> procedures adopted by the State Board. The State Board has also, by way of <br /> Resolution 88-23, adopted petition procedures whereby a petitioner who <br /> believes local agency costs are unreasonable or unnecessary, may appeal those <br /> costs to the State Board. We have enclosed a copy of the petition procedures <br /> and a flow chart which describes the petition process. <br /> The following discussion is offered to further clarify the costs contained in <br /> our invoices. <br /> The invoices contains several categories of costs. Site specific charges <br /> represent those charges for work done that is directly related to your site. <br /> Examples of such activities include: sampling for soil or groundwater <br /> contamination, conducting site inspections, reviewing reports and workplans, <br /> or preparing correspondence. Activities performed for your site are itemized <br /> on the bill . A description of activity codes is enclosed for your reference. <br /> Program management charges include all other County costs associated with <br /> initiating and maintaining program operations. Program management charges may <br /> include such costs as space rental , office services and supplies, purchase of <br /> sampling equipment, training costs, and the salary and benefits of support <br /> personnel (i .e. , clerical staff, accountant, program supervisor) . Program <br /> management charges also include Regional Water Quality Control Board work. <br />
