MONITORING AND REPORTING PROGRAM -2- <br /> RE-MANUFACTURING LTD,RENTAL MACHINERY CO., INC., <br /> AND STANLEY S. MOORE <br /> CLOSURE OF SURFACE IMPOUNDMENT AS CLASS I LANDFILL <br /> SAN JOAQUIN COUNTY <br /> background value as obtained during the appropriate Reporting Period, as follows: <br /> 1) If 10% or more of the samples taken during a given Reporting Period from the background <br /> monitoring points for a monitored medium exceed their respective facility-specific Method <br /> Detection Limit [MDL] for a given constituent,then the Concentration Limit for that medium <br /> and constituent shall consist of the mean (or median, as appropriate) and standard deviation <br /> (or other measure of central tendency, as appropriate) of all the background data obtained for <br /> that constituent from that medium during that Reporting Period; otherwise <br /> 2) the Concentration Limit for that medium and constituent shall be its MDL. <br /> MONITORING POINTS <br /> Monitoring Points (including background) for detection monitoring shall be those listed in this <br /> Monitoring and Reporting Program and shown on Attachment B. <br /> COMPLIANCE PERIOD <br /> Each time the Standard is exceeded(i.e., a release is discovered), the facility begins a Compliance <br /> Period on the date the Board directs the owner to begin an Evaluation Monitoring Program. If the <br /> owner's Corrective Action Program (CAP) has not achieved compliance with the Standard by the <br /> scheduled end of the Compliance Period, the Compliance Period is automatically extended until the <br /> Unit has been in continuous compliance for at least three consecutive years. <br /> Constituents of concern shall include all waste constituents, reaction products, and hazardous <br /> constituents that are reasonably expected to be in or derived from waste contained in the waste <br /> management units (WMUs). Concentration limits in each medium shall consist of background <br /> concentrations of each constituent of concern or concentrations greater than background pursuant to <br /> Section 2550.4 of Chapter 15. For each monitoring period,the owner shall determine whether there <br /> is statistically significant evidence of a release from WMUs and whether the WMUs are in <br /> compliance with the Water Quality Protection Standard using procedures specified in §2550.7 of <br /> Chapter 15. <br /> If the owner,through a detection monitoring program, or the Board finds that there is a statistically <br /> significant evidence for a release from any WMU for any monitoring parameter or constituent of <br /> concern or significant physical evidence of a release from any WMU, the owner shall notify the <br /> Board or acknowledge the Board's finding in writing within seven days, and shall implement <br /> verification procedures within 30 days,pursuant to §2550.7(e)(8)(E) of Chapter 15.
