1.0 REGULATORY REQUIREMENTS <br /> 1.1 SPCC Rule Applicability <br /> The SPCC Rule establishes procedures, methods, equipment and other requirements to prevent the <br /> discharge of oil from non-transportation-related onshore and offshore facilities into or upon navigable <br /> waters of the United States or adjoining shorelines. <br /> This regulations applies to: "Owners or operators of non-transportation—related onshore or offshore <br /> facilities engaged in drilling, producing, gathering, storing, processing, refining, transferring, <br /> distributing, using, or consuming oil and oil products, and which, due to their location, could <br /> reasonably be expected to discharge oil in harmful quantities,as defined in Part 110 of the rule,into <br /> or upon the navigable waters of the United States or its shorelines." <br /> Non-transportation-related equipment or operations,which are subject to authority and control of the <br /> U.S. Department of Transportation, as defined in the Memorandum of Understanding between the <br /> Secretary of Transportation,and the Administrator of EPA dated November 24, 1971,are not subject <br /> to the requirement of the SPCC Rule. <br /> This facility has a non-transportation-related portion that is included under these regulations and <br /> specifically according to the criteria set forth in Section 112.1(d)(2)(ii). This section sets a maximum <br /> aboveground storage volume at 1,320 gallons (gal) total before a Spill Prevention Control and <br /> Countermeasure (SPCC) Plan is required. The capacity of the aboveground storage tanks at the <br /> facility exceeds the 1,320 gallon threshold for a site being required to prepare a SPCC plan. <br /> 11 <br />
