vi. Include a process to make the annual monitoring report and any <br /> notifications under b and c (below) available to the public. Identify <br /> a point of contact for implementing, maintaining, reporting, and <br /> monitoring institutional controls. <br /> b. Within 90 days of ROD signature, the <facility> shall prepare and submit to <br /> EPA and <State> for review and approval an Institutional Control <br /> Implementation Plan (ICIP)for implementing,monitoring, at a minimum <br /> annually reporting on and enforcing the institutional controls at<appropriate <br /> remedial unit> consistent with the BICIP. This ICIP will be appended and <br /> be an enforceable part of this ROD. The<facility> shall monitor the ICs on <br /> the frequency determined as part of the ICIP. At a minimum, the following <br /> information shall be included in the ICIP: <br /> i. Identification of the IC objectives: <br /> - prohibit all uses other than recreational <br /> - maintain soil cover <br /> - prevent construction of facilities or structures or another <br /> and disturbance activity into or on the surface of the <br /> landfill; <br /> ii. A description of the actions required to achieve each objective <br /> (e.g., prepare a survey plat); <br /> iii. A description of how the <facility> is monitoring and enforcing the <br /> IC requirements; and; <br /> iv. A description of the process for removing or modifying the IC. <br /> C. The <facility>will submit to the EPA and <State>, a monitoring report on <br /> the status of their ICs at least annually. The IC monitoring report, at a <br /> minimum, must contain: <br /> L An evaluation of whether all the facility-wide and IC commitments <br /> are being met, including results of visual field inspections of all <br /> areas subject to restrictions; <br /> ii. Description of any deficiencies in the ICIP and BICIP and what <br /> efforts or measures have been or will be taken to correct problem. <br /> d. The <facility> shall notify the EPA and<State>within 72 hours upon <br /> discovery of any activity that is inconsistent with the IC objectives for the <br /> site, or of any change in the land use or land use designation of a site <br /> addressed under item 3(b)(i). The <facility> shall also identify the cause of <br /> the problem with the IC process, evaluate how to correct the BICIP and/or <br /> ICIP to avoid future problems, and implement these changes after obtaining <br /> the approval of EPA and<State>. <br />
