vi. Include a process to make the annual monitoring report and any notifications under b and c (below) available to the public. Identify a point of contact for implementing, maintaining, reporting, and monitoring institutional controls. b. Within 90 days of ROD signature, the <facility> shall prepare and submit to EPA and <State> for review and approval an Institutional Control Implementation Plan (ICIP)for implementing,monitoring, at a minimum annually reporting on and enforcing the institutional controls at<appropriate remedial unit> consistent with the BICIP. This ICIP will be appended and be an enforceable part of this ROD. The<facility> shall monitor the ICs on the frequency determined as part of the ICIP. At a minimum, the following information shall be included in the ICIP: i. Identification of the IC objectives: - prohibit all uses other than recreational - maintain soil cover - prevent construction of facilities or structures or another and disturbance activity into or on the surface of the landfill; ii. A description of the actions required to achieve each objective (e.g., prepare a survey plat); iii. A description of how the <facility> is monitoring and enforcing the IC requirements; and; iv. A description of the process for removing or modifying the IC. C. The <facility>will submit to the EPA and <State>, a monitoring report on the status of their ICs at least annually. The IC monitoring report, at a minimum, must contain: L An evaluation of whether all the facility-wide and IC commitments are being met, including results of visual field inspections of all areas subject to restrictions; ii. Description of any deficiencies in the ICIP and BICIP and what efforts or measures have been or will be taken to correct problem. d. The <facility> shall notify the EPA and<State>within 72 hours upon discovery of any activity that is inconsistent with the IC objectives for the site, or of any change in the land use or land use designation of a site addressed under item 3(b)(i). The <facility> shall also identify the cause of the problem with the IC process, evaluate how to correct the BICIP and/or ICIP to avoid future problems, and implement these changes after obtaining the approval of EPA and<State>.
