Contractors during the course of the Work, whether latent or patent, known or unknown, <br /> which are related to the condition of the Property and/or any of its buildings. <br /> 14. With respect to any claim for indemnity pursuant to this agreement, Property Owner <br /> indemnitees will provide written notice to Permittee, if known to Property Owner, within <br /> a reasonable time that a Claim is made known to Property Owner and for which the <br /> indemnity may be applicable. Such written notice shall be sent to Permittee at the <br /> address provided in this Site Access Agreement. With respect to Claims by third parties, <br /> Property Owner Indemnities shall fully cooperate with Permittee in.the investigation and <br /> defense of such Claims at the sole expense of.Permittee. Permittee shall have the right to <br /> designate and retaincounsel to represent Property Owner Indemnitees in the defense of <br /> any such Claim. <br /> 15. While performing the Work on the Property, Peninittee's Contractors shall maintain at <br /> least the following insurance,with limits of liability no less than those stated below: <br /> Coverage Limits <br /> (1) Worker's Compensation Statutory <br /> (2) Employer's Liability $1,000,000 each occurrence <br /> (3) General Liability $2,000,000 aggregate <br /> (Bodily Injury&Property Damage) <br /> (4) Excess Liability $1,000,000 aggregate <br /> (Bodily Injury&Property Damage) <br /> (5) Automobile Liability $1,000,000 combined single limit <br /> (Bodily Injury&Property Damage) <br /> (6) Pollution Liability $1,000,000 aggregate <br /> 16. The insurance policies provided by Permittee's Contractors shall be primary and any <br /> insurance coverage of.Property Owner shall be secondary. Property Owner shall be. <br /> named as an additional insured on the above referenced Permittee's Contractor's General, <br /> Auto and Excess policies (hereinafter, individually referred to as "Policy" and <br /> collectively referred.to as "Policies") and provide Property. Owner with a copy of a <br /> certificate of insurance evidencing the coverages above prior to commencing Work on <br /> the Property. If any Policy is to be cancelled or will lapse prior,to the termination of this <br /> Site Access Agreement, Permittee's Contractors shall provide Property Owner with <br /> written notice thirty (30) days prior to the Policy(ies)'s cancellation or lapse. This Site <br /> Access Agreement shall immediately terminate in the event that any Policy is cancelled <br /> or terminated or Property Owner is no longer named as an additional insured thereon. <br /> 17. This Site Access Agreement is binding upon and inures to the benefit of Property Owner, <br /> Permittee and their respective heirs,-executors, administrators, personal representatives, <br /> successors, transferees and assigns. <br /> sf-2949921 <br />
