PHS/EHD has prepared the following response to explain <br /> why closure cannot be granted at this time. <br /> PHS/EHD has worked with you to comply with the appropriate sections of the California Health and Safety Code and <br /> the California Code of Regulations, Underground Storage Tank by approving a retroactive permit to remove <br /> underground storage tanks and by allowing the completion of removal requirements approximately 3 years after the <br /> removal activities were initiated. <br /> Following the March 22, 1990 sampling event, PHS/EHD completed on May 25, 1990 an Unauthorized <br /> Release/Contamination Site Report which noted that further site assessment will be necessary and a Notification of <br /> Hazardous Waste Discharge Report which noted that further site assessment will be necessary and that odor and <br /> discoloration was noted by the inspector during the tank removals.The unauthorized release was discovered by the <br /> local agency representative, PHS/EHD staff because petroleum vapor odors were observed at the time of the tank <br /> removal activities. These reports have been provided to you, but are also enclosed for your information. <br /> The detection of an unauthorized release requires compliance with the corrective action requirements put forth in the <br /> Underground Storage Tank Regulations. These requirements state that the responsible party shall conduct <br /> investigations of the unauthorized release, if the regulatory agency requests an investigation, based on the actual or <br /> potential effects of contaminated soil on groundwater resources. PHS/EHD in correspondence dated April 14, 1997, <br /> explained that PHS/EHD reported an unauthorized release based on the PHS/EHD inspector's observations at the <br /> time of the tank removal activities even though the analytical results did not correlate with the observations. <br /> PHS/EHD requested that a work plan be submitted by June 30, 1997 to perform a very limited investigation <br /> consisting of two borings. <br /> PHS/EHD has made efforts to explain to you the reasons why the additional investigation is required. Please <br /> understand that PHS/EHD's position is not meant to be punitive. PHS/EHD will continue to work with you to towards <br /> compliance with California laws and regulations. PHS/EHD requested that a work plan should be submitted by June <br /> 30, 1997 that describes the required soil and groundwater investigation.
