PHS/EHD has summarized the results of the compliance review
for your information and response.
PHS/EHD in correspondence dated April 14, 1996, directed you to prepare and submit by June 30, 1997 a
work plan to investigate the documented unauthorized release that was reported following the removal of
the former underground storage tanks. In your correspondence dated June 16, 1997, you indicated that
you did not agree with PHS/EHD's regulatory directive. PHS/EHD in correspondence dated June 23,
1997, further explained the requirements to investigate unauthorized releases that are put forth in the
Health and Safety Code and the Underground Storage Tank Regulations. PHS/EHD extended the
regulatory compliance date of June 30, 1997 to July 31, 1997.
Please note that PHS/EHD on July 11, 1997 indicated that you were not currently in compliance. The
Cleanup Fund Program allows 90 days in which the responsible party can achieve compliance without
revoking eligibility to receive cleanup fund reimbursements. If the required work plan is not submitted, you
will jeopardize your opportunity to participate in the Cleanup Fund Program. As always, PHS/EHD will
provide any assistance necessary to help you obtain bids and pre-approval so that you can comply with
California laws and regulations.
If you have any questions, please contact Mary Meays at(209)468-0337.
Donna Heran, REHS, Director
Environmental Health Division
Mary Meays, Senior HS Margaret ragorio, REHS
Site Mitigation Unit Supervisor
cc: Elizabeth Thayer, Central Valley Regional Water Quality Control Board
cc: Annabel Mackey, State Water Resources Control Board
A Division of San Joaquin County Health Care Services
