PMER <br /> how <br /> 2. Regulatory Framework - §112.1 <br /> The purpose of this SPCC Plan is to describe measures implemented by Owens-Brockway to <br /> prevent oil discharges from occurring and to prepare Owens-Brockway to respond in a safe, <br /> effective, and timely manner to mitigate the impacts of a discharge from the Facility. <br /> This Plan has been prepared to meet the requirements of Title 40, Code of Federal Regulations, <br /> Part 112 (40 CFR Part 112), and supersedes any previously drafted plans for this Facility. There is a <br /> State of California law that applies to aboveground tanks that contain petroleum: the California <br /> Aboveground Petroleum Storage Act(APSA) in the California Health and Safety Code Section <br /> 25270 (H&SC 25270). The APSA requires that facilities complete a SPCC Plan per the 40 CFR 112 <br /> requirements, perform monitoring to detect releases, and pay biennial storage statement fees to the <br /> State of California if the aboveground quantities of oil on site are in excess of the SPCC Plan <br /> requirements in 40 CFR 112. <br /> In addition to fulfilling requirements of 40 CFR 112, this SPCC Plan is used as a reference for oil <br /> storage information and testing records, as a tool to communicate practices on preventing and <br /> responding to discharges with employees, as a guide to Facility inspections, and as a resource <br /> during emergency response. The information and guidelines held within compile the safeguards, <br /> inspections, and best practices to prevent a discharge to the environment before it happens. <br /> 3. Availability of the Plan - §112.3(e) <br /> Per 40 CFR 112, this is a manned facility(manned greater than four(4) hours per day; therefore, a <br /> copy of this SPCC Plan is available in the Environmental Specialist's office of this Facility and <br /> electronically at the corporate office. If requested, the Plan will be available for on-Site review by <br /> representatives of the EPA or other local regulatory entities during normal working hours. In addition, <br /> copies of the Plan must be available for access to all persons responsible for administration of the <br /> Plan. <br /> 4. Amendments to the Plan by Regional <br /> Administrator - §112.4 <br /> In the event the Facility has a discharge of more than 1,000 U.S. gallons of oil into navigable waters <br /> or adjoining shorelines in a single event, or two (2) discharges or more of 42 gallons or more in a <br /> 12 month period of time, Owens-Brockway environmental personnel will submit the following <br /> information within 60 days of the spill event to the EPA Regional Administrator, and within 30 days to <br /> the California Governor's Office of Emergency Services (Cal OES)Warning Center. <br /> 1.
