Copperopolis Rd., Stockton <br /> Dear Mr. And Mrs. Henry: <br /> This letter is written in response to your letter of May 18, 2003, and recent phone <br /> conversations with our office regarding the above referenced property. <br /> As you are aware, the San Joaquin County Board of Supervisors passed a Board Order <br /> (B-03-278) on February 25, 2003, approving a general plan amendment and zoning <br /> reclassification of two parcels owned by you,parcels 103-110-05 (rear) and 103-110-06 <br /> (front). The Board Order also specified"that no building permits shall be issued without <br /> environmental clearance from the Environmental Health Department...." <br /> At the present time,there is documented evidence of petroleum soil and groundwater <br /> contamination on parcel 103-110-06 from the underground fuel storage tanks removed <br /> from that parcel in 1993. Due to failure to comply with directives to investigate and <br /> clean up this contamination,this contamination case was referred for enforcement to the <br /> San Joaquin County District Attorney in 1998 and to the Central Valley Regional Water <br /> Quality Control Board in 2001. To date, an investigation to determine the severity and <br /> extent of contamination has not been performed. - <br /> In the absence of sufficient information to determine whether or not the environmental <br /> contamination from one parcel has affected an adjacent property,the Environmental <br /> Health Department(EHD)will approve the issuance of building permits for the adjacent <br /> property as long as the well construction requirements set forth below are met. A <br /> minimum 200 ft. annular seal of 10.3 sack, or greater, cement grout mix is required for <br /> any water well constructed on parcel 103-110-05. The presence of documented <br /> environmental contamination on parcel 103-110-06 shall be disclosed to prospective <br /> buyers of parcel 103-110-05. The owner of parcel 103-110-06 will be responsible for <br /> any required investigation and cleanup of any environmental contamination. . . <br />
