As we understand <br /> the project, the basins will be used for the temporary storage and treatment of <br /> soil contaminated with grease and oil hydrocarbons. Since the treatment basins <br /> are located very close to the Canal, a major watercourse in California, we are <br /> very concerned about their design and potential impacts upon the quality of <br /> water in the Canal. We wish to again emphasize that the water transported by <br /> this Canal serves not only agricultural users, but municipal and industrial <br /> users throughout the area, including the city of Tracy. However, we were not <br /> informed of the project or afforded an opportunity to comment or express our <br /> concerns prior to initiation of construction by the City. <br /> On December 6, 1990, we first became aware of the construction work for the <br /> treatment basins and requested, by letter dated December 7, 1990, that the City <br /> not proceed with the placement of contaminated material into the basins until <br /> the Bureau had an opportunity to review and comment on the project. On December <br /> 14, 1990, we were verbally informed that the City was proceeding with the <br /> project without the Bureau's review and opportunity to provide comments. <br /> We request the City not fill or operate the treatment basins until the Bureau <br /> has completed its review of the project. We are proceeding with our review of <br /> the treatment basins based upon information provided by Mr. Paul Verma of your <br /> staff on December 17, 1990, and will provide our concerns and comments as soon <br /> as possible. We expect the City to be responsible for all compliance require- <br /> ments by the State of California Department of Health Services, San Joaquin <br /> County Health Department, Regional Water Quality Control Board, National <br /> Environmental Protection Act, and the California Environmental Quality Act. In <br /> addition, we hold the City liable for any contamination to the water supply <br /> conveyed by the Canal and the surrounding soil. We hold the City liable for <br /> any possible damage to the facilities of the United States caused by its <br /> activities. <br />
