�I <br /> Tosco/BP# 11192 page 2 <br /> 1403 Country Club Blvd.,Stockton. <br /> 2) At the conclusion of the two month period,PHS-EHD will evaluate the effectiveness of <br /> the interim remedial action. The data in the weekly submittal will aid in the evaluation of whether or <br /> not this pumping action will qualify as a valid,appropriate,and effective alternative for the feasibility <br /> study. If the data support conclusions the that pump and disposal method is effective in reducing <br /> the mass and migration of MtBE in the groundwater,PHS-EHD will provide Tosco/BP with written <br /> approval to continue weekly pumping of 5,000 gallons of groundwater at the site. If the data fail to <br /> support conclusions that the pump and disposal method is effective in reducing the mass and <br /> migration of MtBE in the groundwater,PHS-EHD will recommend that the interim remedial action <br /> be discontinued. Moreover,in the event that PHS-EHD directs Tosco/BP to discontinue the pump <br /> and disposal remedial action and Tosco/BP ignores the direction and continues the action,PHS- <br /> EHD will recommend to the State Water Resources Control Board (SWRCB) Clean-Up Fund(CUF) <br /> that the interim remedial action be exempted from reimbursement of costs. <br /> 3) PHS-EHD recommends that additional analysis be conducted on the stored 5,000 gallons in <br /> order to verify the amount of MtBE removed from the subsurface. <br /> In February 1998,the depth to water rose above the screened interval of all monitoring wells associated with <br /> this site and remains in this condition currently. Additional monitoring wells are to be installed so that the <br /> screened interval overlaps the groundwater/vadose interface. <br /> With elevated concentrations of MtBE in all analyzed monitoring wells and the highest concentration in the <br /> most down-gradient wells,(#3 &7) this site's subsurface condition is not accurately represented,properly <br /> investigated,or laterally defined. Therefore,Tosco/BP is hereby directed to submit a work plan by <br /> January 5,2001 to delineate the MtBE groundwater plume. Evidence that the UST system has been <br /> completely inspected and the source of the MtBE impact to the groundwater has been identified and <br /> abated must be submitted to PHS-EHD as well. Additionally, an accurate and current site map <br /> showing all traffic boxes and current site lay out is to be submitted to PHS-EHD by January 5,2001. <br /> Complete boring permit applications and associated fee,any and all County/City encroachment permits,and <br /> any private property access agreements are to be included with the work plan. <br /> It is the intention of PHS-EHD to require that the subsurface investigation and active remediation of this site <br /> be completed in a timely manner. Tosco/BP is to aggressively identify,contain,and mitigate the petroleum <br /> contamination and MtBE plume immediately.
