WASTE DISCHARGE REQUIREMENTS -8- <br /> LIBBEY-OWENS-FORD COMPANY <br /> LATHROP PLANT NO. 10 <br /> SAN JOAQUIN COUNTY <br /> 9. The Discharger shall , within 120 days of adoption of this Order by <br /> the Board, submit a plan to limit mineralization, using the best <br /> practicable cost-effective control technique currently available, in <br /> the discharge to surface water. Upon Board Approval , the discharger <br /> shall implement the plan. <br /> 10. Survival of test fishes in 96-hour bioassay of undiluted effluent <br /> shall be no less than: <br /> Minimum for any one bioassay ------------------------------70% <br /> Median for any three or more consecutive bioassays --------90% <br /> 11. The maximum temperature of the discharge shall not exceed the <br /> background receiving water temperature by more than 40°F. <br /> 12. The maximum temperature of the discharge shall not exceed 66°F. <br /> C. Sludge Disposal : <br /> 1. Collected screening, sludges, and other solids removed from liquid <br /> waste shall be disposed of in a manner that is consistent with Title <br /> 23, Division 3, Chapter 15 of the California Code of Regulations <br /> (CCR) , and approved by the Executive Officer. <br /> 2. Use and disposal of sewage sludge shall comply with existing federal <br /> and State laws and regulations, and the Clean Water Act (CWA) <br /> Section 405(d) technical standards when promulgated. <br /> 3. If the applicable management practice or numerical limitation for <br /> pollutants in sewage sludge is promulgated under Section 405(d) of <br /> the CWA after issuance of this permit and is more stringent than the <br /> sludge pollutant limit or management practice specified in this <br /> permit or in the existing federal or state laws or regulations, this <br /> permit shall be promptly modified or revoked and reissued to conform <br /> to the regulations promulgated under Section 405(d) of the CWA. The <br /> Discharger shall comply with the limitations by not later than the <br /> deadline specified in the applicable regulations, as required in <br /> Section 405(d) of the CWA. <br /> 4. Any proposed change in sludge use or disposal practice shall be <br /> reported to the Executive Officer at least 14 days in advance of the <br /> change. <br />
