25185(c)(3).This is something required by regulation.A statement received within the 30 days, which does not correct
the violations only alerts the department that you are working on compliance. The violations remain open and the
facility has been out of compliance since the inspection and report were finalized. It is understood that APSA violations
may take more than 30 days to correct. The last communication received on the progress was approximately 6 months
ago. It is department policy to send the letter after 30 days if the facility is not in compliance, but because of the
response received, this was delayed. The letter is reminder that the facility still has open violations and that there will be
a charge associated with getting the facility back into compliance. It is not typical for a facility to be out of compliance
for this amount of time, which is why the letter was sent.
Continue to provide updates on the progress.
As stated on the letter this can result in a re-inspection, additional violations and/or further legal action. This is
determined by supervisor review of the file.
As always feel free to contact me with any questions.
FREE classes presented by NES Inc are available to all San Joaquin County Hazardous Waste, Underground Storage Tank,
and Aboveground Petroleum Storage Facility Business Owners and Operators. List and schedule of classes can be found
here.
Thank you,
Cesar Ruvalcaba
San Joaquin County Environmental Health Department
Environmental Health Specialist
1868 East Hazelton Ave
Stockton,CA 95205
R (209)953-62131 A (209)464-01381 0 cruvalcabaPsigov.org
SANJOAQUIN
—COUNTY—
From;Sam Robinson<srobinson@midvallevag.com>
Sent: Wednesday,July 10, 2019 9:36 AM
To: Ruvalcaba,Cesar<cruvalcabaCcDsigov.org>
Cc:Tom Boster<tbosterPmidvallevag.com>
Subject: RE:APSA/SPCC inspection report-16401 E HWY 26-PR0528828
Cesar,
Attached is our RTC transmitted last year with the 30 allowed days.
We are still following our plan for making the necessary corrections. This has proven to be more
difficult than anticipated and is taking much longer than we hoped it would.
We expect to have all of this fully addressed within the next 90 days.
We continue to rely on the language from the agencies Return to Compliance Certification that reads:
"A statement documenting what corrective actions were taken or will be taken for each
violation..." This language is repeated in paragraph 3 of your letter dated July 8 2019.
4
