JANELLE L.FORTNER May 24, 1995 Mr. Dave Smith Mr. Jerry Matthews Herman & Helen's Marina Venice Island Ferry Stockton, California 95219 Subject: Reclamation District No. 2029 Concerns Regarding the Investigation to Determine Extent of Contamination Gentlemen: It is our understanding that you are required to prepare a work plan to investigate the extent of contamination at the former gas tank site located in the levee of Reclamation District No. 2029, Empire Tract. As you know, District approval is required for any plan involving the levee. The purpose of this letter is to alert you of some of the concerns that will be considered when reviewing your plan. Following is a sample of items to be considered when developing your plan. 1. That any persons drilling in the levee must provide certificate of general comprehensive liability insurance naming Reclamation District No. 2029 as insured. 2. No trenching shall be allowed in the levee unless persons representing the District are present. Should expenses occur regarding this inspection, the Marina, or it's contractor, shall be responsible. 3. That drilling shall be limited to 6-inches in diameter. Also, that the persons performing the drilling have a plan in place to control artesian flow should it occur. Also, that drill holes be backfilled immedately with bentonite slurry and that the Marina, or it's contractor shall be responsible for repair should seepage occur from the hole within 2 years of the drilling. 4. That the drill holes shall be logged and resulting data provided to the District.
