be a Preliminary Endangerment Assessment report which is the <br /> basis for the initial scope of work of this Agreement . <br /> This Agreement is also to provide for (1) DTSC' s <br /> consultation and review of site investigation and remedial action <br /> plan documents and implementation documents submitted by the <br /> Agency or its consultant consistent with the Scope of Work <br /> described in Exhibit C and (2) DTSC to obtain reimbursement from <br /> the Agency for costs incurred by DTSC in regards to DTSC' s <br /> oversight of this project . The parties recognize and acknowledge <br /> that notwithstanding this Agreement one or more entities that are <br /> not party to this Agreement (a "Responsible Party" or <br /> collectively the "Responsible Parties" ) may agree with the Agency <br /> pursuant to H&SC section 33459 . 1 to implement the remedial <br /> measures proposed by the Agency and approved by DTSC. <br /> II . BACKGROUND <br /> 2 . 1 Ownership. The Site is owned by the Agency. <br /> 2 . 2 Substances Found at the Site . The Site has been used <br /> for a variety of purposes including a transit company, gasoline <br /> station, and automobile repair facility. Several underground <br /> leaking fuel tanks have been removed. Soil samples indicate the <br /> presence of total recoverable petroleum hydrocarbons, benzene, <br /> toluene, xylene, and methyl tert-butyl ether ( "MTBE" ) . <br /> 2 . 3 Physical Description,. The Site includes the former <br /> Stockton Channel, the former Shell gasoline service station and <br /> the current, but abandoned, Bridgestone Tire and Auto Repair <br /> facility. The Site is an asphalt paved lot that overlays the <br /> Stockton Channel which is supported by wooden piers . Surrounding <br /> the Site are commercial buildings including offices, service <br /> stations, and a hotel ; parking lots and vacant lots . <br /> 2 .4 Site Histor. From the turn of the century until the <br /> 1950 ' s the Stockton Channel extended east to North El Dorado <br /> Street and was utilized by various freight and transportation <br /> companies for storage of merchandise . By the 1970 ' s the <br /> Stockton Channel ended at North Center Street and the property <br /> was used as a parking lot . A gasoline station was located at the <br /> northeast corner of the block. Hazardous substances likely to be <br /> present are those associated with gasoline stations and auto <br /> repair shops and includes fuels, oils, greases, solvents and <br /> heavy metals . <br /> III . <br /> AGREEMENT <br /> 3 . 0 IT IS HEREBY AGREED THAT DTSC will provide review and <br /> oversight of the response activities conducted by the Agency in <br /> 2 <br />
