The training program was lacking or insufficient. The training program did not address the immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency (spill reporting requirements). Training programs for all employees and annual training, including refresher courses, shall include safety procedures for the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the facility's emergency response plans and procedures. These training programs may take into consideration of each employee. Immediately prepare or update the facility's training program, log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. This was corrected on site. This is a Class II violation. 9 HSC 25508(a)(1) Failed to annually review and certify that the business plan is complete, accurate, and up to date. The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System(CERS) annually for 2018 and 2019. The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 10 HSC 25508.1(a)-(f) Failed to submit revisions to business plan within 30 days of substantial change in operations. During the inspection two 115 cubic foot cylinders of compressed oxygen were found and the updated information has not been submitted. Within 30 days of one the following events, business shall electronically update the information submitted to the California Environmental Reporting System (CERS): -A 100 percent or more increase in the quantity of a previously disclosed material. -Any handling of a previously undisclosed hazardous materials -A change of business address, business ownership, or business name. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This was corrected on site. This is a Class II violation. 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. Employee training records were not available at the time of inspection. The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years. Immediately provide employee training for appropriate personnel and submit a copy of the training records to the EHD. This is a repeat violation, Class Il.
