Tracy Material Recovery&Transfer Station SPCC Plan <br /> 1.0 INTRODUCTION <br /> 1.1 Background <br /> Title 40 of the Code of Federal Regulations (40 CFR) Part 112 requires that facilities subject to <br /> federal oil pollution prevention regulations develop and maintain a Spill Prevention Control and <br /> Countermeasures (SPCC) Plan. The State of California incorporates 40 CFR Part 112 by <br /> reference into California Health and Safety Code Section 25503.4. Federal oil pollution <br /> prevention regulations apply to facilities that have bulk petroleum storage that exceed the <br /> following thresholds: <br /> Underground storage capacity(total):42,000 gallons <br /> Aboveground storage capacity(total): 1,320 gallons <br /> In accordance with these regulations, a facility must address all containers of oil that are equal <br /> to or greater than 55 gallons. <br /> This SPCC Plan has been prepared for Tracy Material Recovery & Solid Waste Transfer, Inc. <br /> (TMR) and is designed to prevent releases of oil and to mitigate the effects should an oil leak or <br /> spill occur. This SPCC Plan was prepared in accordance with the regulations of 40 CFR, Part <br /> 112.7 (40 CFR §112.7) and any other applicable section of 40 CFR Part 112. This SPCC Plan <br /> meets the requirements in the revised regulations that were effective on January 14, 2010. A <br /> cross-reference of applicable regulatory requirements and the locations where they are <br /> discussed in this SPCC Plan is provided in Appendix 1. <br /> This SPCC Plan shall be maintained at the Facility at all times. <br /> 1.2 Certification of Substantial Harm Determination Form <br /> The Oil Pollution Prevention regulations of 1990 (OPA 90), originally promulgated under the <br /> Clean Water Act, directs facilities that could cause substantial harm to the environment by <br /> discharging oil into navigable waters of the US to prepare and submit a Facility Response Plan <br /> (FRP) for responding to a worst case discharge of oil and to a substantial threat of such a <br /> discharge. Under 40 CFR 112, Appendix C, facilities that do not meet the substantial harm <br /> criteria are not required to maintain a FRP; however, they must document and maintain their <br /> determination as part of their SPCC Plan. The TMR Facility does not meet the substantial harm <br /> criteria; therefore, it is not required to maintain an FRP. A certified Substantial Harm <br /> Determination Form for the Facility is provided in Appendix 2 of this Plan. <br /> 1.3 SPCC Plan Review and Certification <br /> In accordance with 40 CFR §112.3, this SPCC Plan has been reviewed and certified by a <br /> registered Professional Engineer(P.E.).This certification is provided in Section 1.4. <br /> October 2019 1-1 <br />
